UTICA — Linda Sullivan Fatata, former Utica Corporation Counsel, was found not guilty Thursday in town court for a coffee shop incident involving her former employer.
Fatata had been charged with second-degree harassment, a violation, for the incident at Daily Donuts in the village of New Hartford on March 23.

The incident involved Fatata, former Mayor David Roefaro, and Sabahudin “Budo” Mukic, former Utica Urban Renewal Agency marketing director.
Mukic and Roefaro had said they drinking coffee that day when Fatata drove by and confronted them, and that she spilled coffee onto Mukic.
Fatata had a different version of the confrontation, saying Mukic threw his coffee onto her.
A slew of past and present City Hall employees testified at the non-jury trial in front of Town Justice James Van Slyke, said Fatata’s attorney, Stephen Lockwood. In addition to the three involved in the incident, current Facilities Director Michael Mahoney testified that Fatata came back to the restaurant he leases from her brother, Robert Sullivan, with coffee on her after the incident.
Robert Sullivan, the city’s former economic development commissioner, testified about a confidential memorandum he submitted to Roefaro and human resources personnel in November 2010 – when he was still a city employee – about Mukic’s treatment of city employees, Lockwood said.
Just a few months later, Roefaro fired Fatata, Sullivan and Robert Palmieri – who was then codes commissioner but has since won election as city mayor after Roefaro decided not to run.
Oneida County Assistant District Attorney Michael Nolan prosecuted the case.
Ultimately, Van Slyke ruled in favor of Fatata.
“Justice prevailed,” Lockwood said.“Linda made an excellent, very credible witness.”
