Lenoir City man gets 5 years' probation in fatal shooting

A Lenoir City man who admitted shooting and killing his girlfriend during an argument last year will receive five years' probation for the crime. John Kenneth Harvey, 26, was arrested in February 2008 and charged with second-degree murder in the death of Savannah Kathy McMahan, 21. Prosecutors said they reduced the charge to reckless homicide and agreed to five years' supervised probation after reviewing the evidence in the case.

Oh my goodness! Now this is sad as it gets. A young woman has been killed and the killer gets five years probation. Loudon County is getting a good reputation for letting murderers get away with killing our sons and daughters. What has happened to this place? I think I know. Can you say election?

i knew that the sentence would not be enough from the beginning. i just never expected for it to be so minimal. cass was my best friend and can never be replaced. if you read the whole story, it says that the DA reached that decision as a comprimise with the parents. i have been around her father and brother since it happened and NEVER did they contact her father. they may have consulted her mother (who did not play a major role in her life) and stepfather, but not her real Dad. it is all bullsh*t! what happened is that johns dad bought him off.

Although the voters of Tennessee voted in the Tennessee Crime Victims Bill of Rights by a 10 to 1 margin in Nov 1998, no funding has been approved to enforce it, therefore DA's can still initiate, discuss, and implement plea bargains WITHOUT the knowledge of the victims or their families much less their permission.

6:15 pm St. Mary's (Mercy) Hospital off Broadway behind Fulton High School 06/25/09 is the next meeting of the E TN Victims Rights Task Force. Parking is free in the Tower Parking Garage.

Has this dude, Russell Johnson, gotten any convictions since being elected as the Loudon County DA? I just can't bring myself to believe some of the crooked stuff going on around here. I know who is behind it all but how do you stop them? There has got to be a way. Loudon County is suffering.

Yes.
A short while back he kissed TVA's butts by prosecuting an envirinmental activist - for putting up an air quality monitor near the Kingston coal-ash spill.

Has anyone noticed the growing amount and repeat names of non-licensed, no insurance, DUI ..etc offenders?

Which one of our loved ones are going to be killed by offenders before the proper officials do their jobs to protect the citizens?

Please post convicted pics and lic # for neighborhood watch and public records.

We all have the need to know.

Did y'all see where the Lenoir City court shut down its office for over a week so that everybody could go on vacation? I have never heard of that happening in a government office. Must be nice. The city could have really used that money!

Does anyone know how to get ahold of either of Cassie's parents? I knew Cass when she was in middle school and knew both parents pretty well but I haven't seen either of them in several years. I didn't get to go to the funeral because of illness and haven't seen anyone since before she died. If anyone can help, I would appreciated it.

This story sheds some light on why Russell Johnson recused himself from the Houston brothers' murder cases. It's two serious cases (law officers slain) and he needed the Supreme Court to appoint some special prosecutors who could handle the job!

His excuse was that his Assistant DAG, Frank Harvey, might be subpoenaed as a witness. Both brothers have now been through one mistrial. Did anyone see Frank Harvey called as a witness in either case?(If so, please give me a link.)

We should see a revolution at the polls this year. Let's finally make a stand and get rid of the in-laws and outlaws downtown! It should be a law that every citizen must vote in every election possible. If not, they could lose their right to vote. The freedom to choose our leaders is the reason millions of people came to this country. If those who never bother to vote suddenly woke up in a country with a dictator, they would see what they are taking for granted. They would never again miss a chance to make their vote count.

Why can't Rep. Jimmy Matlock, Dennis Ferguson and Senator McNally introduce a bill that gives the people the right of recall? If the voters elect someone to office and he or she isn't doing their job, the people should have the right to fire him or her with recall.

Term limits are also needed - instead of a district attorney general getting elected every 8-years cut them down to every 4-years or 2-years.

Kinda interesting that Russell Johnson wants to oust the constable in Roane County so why can't the people oust Johnson for his gross incompetence?

Johnson was a title attorney, does anyone know if he ever handled a criminal case before he was elected?

Johnson is making himself and Loudon County look real bad by giving a murderer 5-years probation for killing someone!

He had never tried a case before. He did title searches. How he got elected is beyond my understanding. If you want to see them in action go set in his uncles court.

It doesn't matter if he got probation because of the DA. If he had went before Judge Elblen, he would have probably gotten even less! As the former DA told my family when we had a loved one killed, "We have to pick and choose the cases." He told us basically that her death wasn't enough to try and take them to court. He was just going to let it go. Until we protested outside his office and caused much more trouble for him. The Assitant DA Frank Harvey took the case and was extremely kind to us and worked really hard. He did an excellent job in court. However, "honorable" Judge Eblen slapped them on the wrist and told them to be good boys. Sickening! He's looks like he over 100 years old and so do his hateful baliffs. I just hope our next criminal judge is a hard-@$$ on EVERYBODY! I would like to think they would have the personality of Judge Judy. Maybe we would have less crime b/c the criminals were having to ACTUALLY go to jail or prison!

At the next E Tn Victims Rights Task Force meeting at 6:15 pm in the Shamrock Room at St. Mary's (Mercy) Hospital in North Knoxville, we are discussing how we can track, monitor, and hold accountable the judges in this area. Too many of them are violating the Tn Crime Victims Bill of Rights, and as it has not been mandated by legislatur, it is not being enforce.
We are hoping to change that. I hope you will come.
