First, there is absolutely no excuse for an adult to have sex with an adolescent retarded or not and consensual or not.

But before we leap to wild conclusions making mindless monsters out of people, let's consider some things that are relevant.

Never! Sex with minors is a crime whether the minor cooperates or not. If the minor cperates then it is considered statuatry rape punishable by law.

Why? Because a minor is considered to be emotionally immature to give responsible consent. andthe adult is viewed as taking advantage of that immaturity. So even if consent is given the law will seek punishment for the adult involved.

Where mental retardation is involved the crime is even more serious because the mental retardation reduces the adolescent's ability to effectively resist adult cunning that might be used to entice the adolescent into having consensual sex.
