Can my daughter be issued an underage drinking ticket because of a pic on facebook and no breath test taken?
ticket was mailed two months later, Was asked about it by principle at high school with no counsel present. Was given a choice to admit to it and get suspended for 1 cross country meet, or deny it and get suspended for 6 meets. ticket was mailed 2 months later
This sounds highly suspect, and the actions of the school administrators here are terrible. On the other hand,...
My son was given a release date from jail and he thought it was wrong so he kept contacting the jailers to have them get it corrected to the right date. They kept coming back and saying it was correct. Well in the middle of the night they came to tell him he could be released but that he should of been let out 7 days earlier, so my son was correct. Now, I'm wondering if he can get some kind of restitution for serving more days than he had to ?? This is terrible, having to sit and extra 7 days when he could of gotten out, if only they would rechecked like my son wanted him to.
This is really a question for a civil litigation attorney. You should repost your question in that section. As a...
I'm 16 & was charged with underage drinking while at home in my yard while my parents were home & want to fight it. Any advise?
I want to fight the fine in court because I don't think it's right since WI law says you can drink under 18 at home with a parent. I had friends over who brought their own beer given to them by their own parents. My parents were home but didn't know we had beer outside so when the police showed up we all received fines for underage drinking. My parents sometimes allow me to drink but never while around my friends or when out only at home. Can I still get a fine for this even though my parents didn't supply the beer?
Yes. The applicable statute is Wis. Stat. s. 125.07(4)(b). Wis. Stat. s. 125.07(4) Underage persons; prohibitions;...

Get an attorney. Review all your options before you despair.
What if I get beat up while the police are taking my blood and then hit and abused after email@example.com
I was already pulled over and stopped, asking two little old lady's directions a police officer came to the seen and asked me to get out of the car he said someone called in a weaving car. I was trying to read a map while my passenger was actually driving and the car was on cruise control going down a highway. I stopped at a gas station filled up bought some food and then went the wrong way and found the lady's. the car was legally parked. I was arrested after the breathalyzer the passenger was free to go with groceries and beer. The car was towed and I told the police that I had $1800 under the seat and a valuable computer in a case in the suv some stuff was stolen from the computer bag and they said there was no $1800. I spent 4 days in jail before I could get the deputies to run my bond
If you were in the driver's seat and failed a breathalyzer test it is going to sound like DUI. Based on your story, you...
If the DUI is in a state with lesser penalties but the impact on the accused will be much, much more severe in the licensing state, it was suggested to me that a "mitigation letter" from my attorney could possibly result in pleading to a lesser charge. Does anyone have any experience with this?
It might help but prosecutors are often concerned solely with whether a crime occurred at the charging stage,...
