I had a dui in June 2004 and was put in a diversion program that withheld conviction. Less than 5 years later i got another dui .13, in my driveway. Will they consider this a first or second offense? I've been told not to hire an attorney as it isn't necessary since the penalties are so cut and dry. Is this correct?

My brother was recently detained in Florida while on vacation. He had an outstanding warrant in Florida, orange county, for bail jump after being arrested for DUI (2nd I believe) and driving on a suspended license and possibly probation violation. I was being charged CT-DUI WITH MINOR IN CAR OR BAL OF .20 OR HIGHER .. first of all, I was alone in the car and second even though the cop wrote that I smelled of alcohol when we got back to the station I blew .0000000 ... NO ALCOHOL ! He still insisted I am under the influence of something because my eyes are low and my speech. He also tried to say in the report I had to use both hands to get out of the car .. well DUH ! I was in major pain with a boil in my stomach that I can feel every movement of . I didn't have any of the pills on me. Point is, how can they PROVE I was actually intoxiated at the time of DRIVING? I was pulled over for speeding. In my experience if you provide them with the Order expunging your record they will remove the photo.
