Wellington Law

I received a first-time DUI with a BAC of 0.17 (in 2013). I have no prior record of substance problems or any legal record at all. My disposition hearing is not until April, by which time I will have already completed the initial 24 hours of Level-2 Alcohol Education (I have gone "self-referred," as I don't have a P.O. yet to assign me to classes or perform an alcohol evaluation). I will be pleading to a reduced DWAI. I'm getting conflicting information: online I'm reading that Alcohol Therapy is always mandatorily assigned, but in my Education group sessions multiple people (with similar first-time, high-BAC DUIs) have told me they were not assigned to any therapy. Is this true? Is there any chance that I will not be assigned to a track including the additional Alcohol Therapy hours?
You need to speak to an attorney ASAP. You are in a precarious situation with that BAC as it's right on the line under...
I am on probation for a DUI, last weekend I received a summons ticket walking home with a drunk friend, who had punched out a car window. We all received a criminal mischief ticket under 500. I am scared they will send me to jail over this, I have been sober and almost completed a year and a half on probation keeping up with BA, and classes. This will be my first violation. What will happen to me? or what can I do to avoid jail time.
Your probation cannot be revoked for an alleged new criminal violation unless the charges are proved beyond a...
Got DUI - Pled Guilty - 9 month License Revocation - Early reinstatement after 30 days - Get my restricted license on Nov 10th with interlock installed - Need to move to California by Jan 15th - I will still be on probation. I know i only need permission in regards to moving out of state from my probation officer and I can transfer any education classes i have left to complete. Curious about my driving status in California.. I may be eligible for early removal after 4 mouths of interlock with no bad readings. However I have to be in California within 2.5 months. And I will still have 6.5 months on my restricted CO License.. What are my options in regards to driving in California.. Thanks For Your Time ... Mike
Mike: the "letter of the law" answer is this - you must agree to (1) be a CO resident when you enter into the Interlock...

Unfortunately, no.

If you move to CA "temporarily" you can keep your CO restricted license and get the monthly downloads done in CA. Then...
I know the answer is "No" with the DMV, however the current probation laws have changed: they require ETGs with those currently going through his or her DUI. Such people aren't able to drink alcohol for an extended amount of time. Inevitably, those same people are getting their interlock devices out early... The DMV is rewarding these people with a shorter interlock device, but they aren't teaching them anything! What I'm trying to say is, these new DUI laws are not teaching DUI offenders to learn to properly abstain from drinking and driving! Can I petition to change the law for those (such as myself) that are required to have an interlock for 2 years and without a chance for early removal? I can have drinks, I don't drink, I have learned not to drive after drinking
A change in the law requires action from the state legislature. You will want to contact your state representative and...
I was capable of getting my license back on august 29th, after more than 2 years without a license, this is my second offense. My question is, on the .gov website about interlock it says if I refuse I only have to have interlock in my device for 1 year. Why do they make everyone do 2 years with it in their cars? I am looking at going to grad school in a year and would like to see if there is any legal way for me to only hold this in my car for 1 year.
You are misreading their misleading information. It is two years.
