You plead guilty to the dui that you received on Feb 1st first then can the state raise the first dui from Jan 1st to a dui 2nd if you was not convicted of the Jan 1st at the time of the arrest?

I have a smart start interlock device and blew my first violation. Will this affect the non-adjudication requirements?
I have had the interlock device in my car for a month now and have never blown anything but a PASS. This morning when I went to start my car I blew a violation/fail. I did brush my teeth and know that can cause the fail. But, last night I went to a Christmas party and did have three drinks and made sure I drank water and had a designated driver. Could this have caused the violation? If so will it affect my non-adjudication? I had my roommate drive me to work rather than risk it. I know alcohol can stay in your system for a while but I am having a slight panic attack thinking that I have just ruined everything. Any advice will help.

Pulled over for failure to use turn signal in an appropriate time to turn ratio. Pled guilty to DUI. Did three months. License not suspended at that time. Received 2 yrs probation, community service, fines etc. Upon release was unable to fulfill states requirements. Tried repeatedly to check in within 24hrs. Probation officer never available. Alternate PO not available. Living on streets of Denver. No money, no car, nowhere to go, nothing to eat for a week. Left state. That was over 11 yrs ago. License suspended now. Very stable now. My husband is charged with DUI. I was the extremely drunk one and we were having an argument outside. the people surrounding us called the cops about noise. The cops never saw him driving but he admitted to driving and blew over the limit. Our attorney is recommending a plea deal where he pleads guilty to DUI but receives the bare minimum in punishment. The attorney has said that the arresting officer's account is very sympathetic towards him and that she even mentions he did not appear drunk and passed the field sobriety tests but based on his answers, she gave him the breath-test. I know he broke the law in trying to take care of me. Do you think the prosecutor might agree to a lesser charge with the same punishments if I talk to her and explain what it will do to our kids and my husband

I was recently charged with dui. My son was arrested for DUI. passed 4 breath tests and 4 field sobriety tests. He was then charged with DUI-other. He requested a blood test but when they got to hospital, officer said it would cost $365 for the blood test. My son is in college and didn't have that kind of money on him and was not allowed to contact anyone to help pay it. He has refused plea deal and case going to trial. Cost to date $6000 with $1200 in court costs now due. Financial hardship has caused him to drop out of school to pay expenses.
