Blew a .086 on a field test and was taken in for blood test then released, what are my options?
Was driving back from a friend's house and was flagged for speeding. (not radared but based on cop's estimation). Committed the two big no no's unfortunately, and told the cop i had a beer and submitted to the field test and breathalyzer twice (blew a ,086). I agreed to be taken to the hospital to get a blood test and was allowed to be picked up and taken home instead of taken to jail. What should be my next steps as to fighting this case (kind of dug myself a hole) and if my blood test come back under ,08 will they help my case at all? Will this blood test result be available to me or be released? Thanks in advance for any advice.
Be sure you (or better still your newly retained attorney) contact the DMV within 10 days of your arrest to request an...
Will I need an SR-22 if my statute of limitations has been exceeded to get my license back in the state of California?
I was charged with a misdemeanor DUI (not sure what my BAC was) as a minor, 3 days before my 18th birthday. It has been approximately a year and my case hasn't been filed. A year passed 8 days ago. Will I need an SR-22 from my insurance company? Thanks
Even though there hasn't been a case filed in court you still have the DMV to contend with. I would need more...
My fiancé was charged with a felony dui because it was his 4th. However, he was given as part of his punishment so to say that he would have to complete 6 months in an in patient program. We are wondering if there is anything we can do to avoid this since he will loose his job because of this and let's be honest is cutting people off from the ones that love and support them and sticking a bunch of people that have the same issue in a home together a good idea??? But his case was finalized last April and he hasn't had a drink since 2012 when his last dui was. We really need some legal advice and guidance. Thank you for your time.
What you are saying makes little sense. You said that he stopped drinking in 2012....how can that be as he was...
Dui license suspension
DUI license suspension questions. I was convicted of a DUI in January in my personal vehicle. The DMV suspended my license for 6 months then send me a letter to disqualify my commercial class B for 1 year. My questions are 1. When could i start driving my class C regular driving again 2. Will that downgrade my commercial class B license? So how long do I have to wait if I want to receive my commercial license back? Do i have to take the test again 3. do i have to retake the test after 1 year? 4. So if i want my license back right now they will downgrade my class b to class c and if I wait one year i still have to retake the test again. Then what is the difference?
1. It depends. On a DUI there are typically 2 suspensions. One suspension is 6 months from the court conviction, but...

IS my license still suspended if it was returned to me the night of my DUI? Second blow was .07 once at station and i released.
Had 2 beer's. Blew a .085 was not taken to jail due to heart condition and multiple medical problems. Am not coordinated due to lack of motor skills and health issues. CHP officers were very polite and understanding to my health issues. CHP took me to the station to fill out paperwork and blow again. Blew a .07 at the station and had my license then returned to me and was released to a friend who drove me home in my car that was not impounded. I am on multiple anticoagulants and blood thinners as well as anxiety medication. I am approved by doctors to enjoy a alcohol on occasion. Confused about payments that i need to make at the DMV and what i need to apply for a license ? Live far from work and lot's of doctors appointments as well as weekly blood tests
It sounds like at this point your license is valid. You should contact an attorney or Mandatory Actions in Sacramento...
2nd DUI with bodily injury and Child Endangerment
Dad drove drunk with our children ages 3 and 6 at the time. This is his second offense DUI and as a result of the accident our daughter received a large laceration across her forehead. Our son was not in proper booster seat and our daughter was not properly strapped into her car seat. From what Ive read in the reports he also hit parked cars and driving in a car that was not his. What I would like to know if he's facing any jail time? He's also evaded the law from arrest and finally got arrested on a warrant last month. The accident happened in Nov and he was let out of jail on imperative reasoning. So Im trying to understand whats more likely to happen during the trial.
The bodily injury to others means that the DA can charge it as a felony offense. Particularly given the child...
