This brother does not have a driver's license. His was suspended after his most recent DUI. This was his 3rd DUI; also has public intox charges. Bottom line is that I wouldn't let him borrow a bicycle and certainly am not willing to assume liability for his driving an uninsured car without a license. He is one of the trustees and says he has a right to drive it as a trustee. It was supposed to be sold a couple of months ago but he continues to use it as his own. (Our father died over 3 months ago.) Do the beneficiaries have liability and what can we do to prevent his use of the car and failure to sell as agreed? This is my first DUI and I have no other arrrests of any kind. I have contacted the only 4 local attorneys I can find that handle DUI cases and have called and left messages for them each twice over the last 10 day. My court date is in 2 days and I still haven't been able to schedule even a consultation. My case is not complicated, I am polite and respectful in my messages, and I am able to pay any fee's associates with hiring an attorney. What am i missing? 1st offense DUI occurred 6/2010. Conviction date 11/2010. Was placed on informal 24 month probation. Arrested for 2nd offense DUI 7/2012. Have file motion to suppress based on officer had no grounds to pull me over. In Jan 2012 I was in a alchol related accendent. We hit another car and FLIPPED downed a 25ft incline. I apparently said I was driving, I had broke the window out with my head also lost control of my bowels. The county atty wants me to plead guilty to public intox, but carry the plenty of a OWI my lawter now thinks I should take it. I feel I have already paid by the night in jail and the fact that this DWI will be on my driving record for the next 12 years.
