I have 2 misdemeanor DUIs from when I was 18 in 07 that I was sentenced for in 09. I was sentenced to probation for the 2nd one prior to the court date for the 1st in a diff. county after having probation revoked twice before for non-payment of fines from a misdemeanor damage to property while i was 17 in the same county. I was awaiting sentencing for the 1st in their county jail with a hold in the other for petition to revoke probation for my fines. I was homeless at the time so I requested to be given jail time instead of more probation & fines because I knew history would repeat itself. The law about court fines has since changed & my 5 year revocation of my license has finally passed but i am now a struggling single mother. My brother has 5 convictions and 1 supervision, not sure there is a difference between the two. The prosecution is charging him with a class x felony, the dui's are the only thing on his record and he's never been in an accident. He has anxiety, alcohol and depression issues and is on lots of medication, which is obviously no excuse, but I'm wondering there are any ways to reduce this to class 1 instead. Our lawyer who represented him last case has said there is nothing he can do. Is it worth looking at another lawyer or is the prosecution's mind made up? With a class x felony 6 year sentence how long would he have to serve? With jail overcrowding is he at all eligible for work release or something similar? Any advice is appreciated.

In 2007, I was arrested for 2 misdemeanor DUIs in different counties within 2 mos of each other when I was 18. I went to court for 2nd arrest 1st & was sentenced to probation, fines, com service, impact panel, & classes. Then at court for 1st DUI arrest, public defender told me I should have been offered supervision for my 1st offense because of Illinois DUI laws & mandatory sentences per DUI. I asked 4 jail time instead of probation because I was homeless & would not have any $ to pay for fines. Also had probation in a diff county revoked two different times for a misdemeanor destruction of prop&underage drinking charge when i was 17 for failure to pay fines & court costs/fees, but was given the exact same sentence as my 1st DUI. I know DUI laws have changed a lot since 07 just curious.

In 07, while I was 18, I was arrested for two DUIS in different counties within 2 months of each other. I ended up getting convicted of the 2nd DUI first and sentenced to 2 years probation, then for the 1st I requested jail time instead of fines and probation because I was homeless. I was declared indigent then given 2 yrs probation with almost 2k in fines. I became unemployed a few mos after I was ordered to set up the payment plan for my fine and havent been able to pay since. I cant get my license back without it and cant find work without reliable transportation. I am also a struggling single mother. I cannot afford to make more payments and need my license but it would take me years to pay it off. I am desperate for any help out there so I can finally change my life for the better!!!
