I have completed all. My attorney stated that since i already completed 18 months of Alcohol education on my prior, the was no req. for it on this case, nor was it stated on my sentencing sheet. I just called DMV, MAU and the lady, stated my license is revoked for 3 years which i know, when i asked what can i do to get it reinstated, she said 12 months of an 18 month Alcohol class, when i said my terms and attorney stated i didn't need to, She says,'Either do it or DON'T" (someone didn't get laid i guess) and hung up. I called my Alcohol class and they are sending me my completion on the second DUI showing i finished my 18 months. What are my options at this point? Any help would be greatly appreciated, the attorneys on this board are so knowledgeable. Thank you and GOD BLESS.
The DMV and the court are two separate things. In order to get a license back, the DMV can require you to do things...
Can I apply for restricted license alongwith the IID installation or do I have to wait for the restriction period to end?
If you have been convicted in court of a DUI in Los Angeles the DMV will require the IID. Once you are approved for...
i refused the breathalyzer at the scene, and blew a .08 at the station. The officer also took my blood as he felt i was under the the influence of other drugs. I had snorted a few lines a cocaine an hour before he pulled me over and smoked marijuana about 10 minutes before. The officer did not find any marijuana or cocaine in the car. I have spoken to a handful of lawyers and they have told me since my breathe test was right at the limit .08 and since this was my first offence they might be able to drop the charge down to a wet reckless. However, the blood test will show that marijuana and cocaine in my system. How will this affect my charge?
You might get to court and the blood test could be unavailable. A lawyer will not want to volunteer the drug...
I had no permanent address, so I could not get a califonria license. I stayed on and off with people for a while. After I got arrested, and after my court date, I got an apartment. I still have my indiana id, can't get ca id, Because I don't have my birth certificate I would have to get that first. I. was misinformed. I was never told I had 10 days to challenge the dmv. I was also never told I had to surrender my license, I knew it was suspended. The police told me it WOULDNT be suspended. I should have got a lawyer, I need one! I think it's fair that I am able to take my classes online, do u think the court would understand?
No. CA doesn't recognize on line DUI schools. If you are living in CA and ever want to get a CDL you'll have to take...
Pretty self explanatory in the question. Was ordered on April 15 to have an IID installed for a year (per probation requirement for 2nd DUI). I just need to know how long I have to go get it done. I am making car/insurance arrangements and I also want to see what the outcome of my DMV hearing will be. (i.e. Whether they stay the suspension of my license). It was ordered out of Van Nuys courthouse.
If you were convicted of a 2nd time DUI you will have to sit out a 90 day hard suspension. Then you can get the IID...
MY INMIGRATION ATTORNEY TOLD ME THAT FOR FEDERAL INMIGRATION LAWS STILL SHOWS THE 2 MISDEMENORS , SHE TOLD ME THAT I NEED A CRIMINAL ATTORNEY WHO CAN ACTUALLY GET THE DUI DISMISSED OR REDUCED TO AN INFRACTION
Was the DUI a felony? Even if it was a misdemeanor, you must still declare it for immigration purposes. You can file...
Long story short, got my second DUI and am thinking about hiring an attorney. Just curious if there are any cases or California case law that says the officer can have cause to arrest me for refusal of field sobriety tests, and whether that can infer that I am guilty. My blood eventually was over the limit. Any direction would be great....
No, it does not, and you may even refuse to submit to the field sobriety test. However your refusal to submit to the...
