My father in-law was stopped for no seat belt with his two daughters who are 23 and 16. He was asked to take a breathalyzer and he agreed. first test was .08 which is the legal limit was asked to blow again and blew a 1.0. Before being transported to the hospital the officer was asked by the eldest daughter how much the bail would be "you guys wont be able to afford it" was his reply when asked again " well how much will it be?" he replied "$3000.00". At the hospital his blood test results were .06. He was arrested for DWI,open container, and no seat belt. When family went to post bail the officer pulled one of the family members into his office alone and told the family member, "you know, I can be a jerk and add child abuse to it." when the family member replied " you are the law you do what you have to do." the officer said ok there is no longer bail i'm adding child abuse. He has spent 10 days in jail after his arraignment and now is being held by ice as of today. family members were told to pay $5000.00 within 24 hours and he would be released. if not he will be deported within the following 24 hours if not paid. With all cases still pending.
Unfortunately 0.08 is over the legal limit. So both tests support DUI. The child abuse probably won't stick. DUI should...

Do you have a legal question?
Currently in NM and have dwi pending. I refused breath test. First offense. Drive a company car for work and will not allow interlock device. When arrested had CO DL and after arrest got NM DL. I am trying to move out of state and want to obviously avoid interlock device to keep my job. Was thinking about getting a license in georgia due to non compact state. Do you think if I was pulled over in any state with Georgial DL would the officer be able to see this information and would most officers arrest me? Does this sound like a way to avoid the interlock? Any other advice is greatly appreciated!
No one is going to really advise you on how to avoid an interlock when there clearly is a reason for the device to be...
I was arrested on dui. in 2001 while visiting the state. I went home (out of state) never to return. I recently tried to get a D.L. in the state of New Mexico.I was given a printout I still had to take care of the problem in ILL.I called the police dept. who made the arrest 12years ago The told me I still had I warrant for failure to appear. How long does this arrest stay on there books. Can I get a D.L. in any other state without going back to ILL.
The statute of limitations has been satisfied because charges were filed. Furthermore the statute of limitations does...
Violation of implied consent act, how does the IID requirement work when dealing with 2 separate cases with a time lapse in NM?
So I have had the administrative hearing and was found guilty, but have appealed it and waiting to hear back from judge(I will be found guilty at some point). I did this to extend my driving priveledges. I have criminal trial soon. If I lose trial and appeal it, which can take 1.5 years to appeal, will my one year IID req. for the administration portion fulfill the criminal IID requirements, and after I reinstate my license will I be good to go or would I have to be worried about a second hold on my license after the appeal comes back on the criminal side? I am planning on moving out of state before getting convicted on administrative side. Your help is greatly appreciated!
Many states share convictions on drivers licenses. Stay and take care of everything!!!
My husbands employer has stated that someone has brought it to their attention that he has a dui on his driving record. He does have this on his record but it happened a year and a half ago. Now they are requiring him to submit a consent form for them to pull record to confirm. Our concern is that no one has brought it to their attention and that they pulled his driving record without his consent and now are trying to cover their tracks. He has never lost driving privileges and hasn't reported mileage and gotten paid for it . As in the company policy it states that anyone that drives for the company with their personal vehicle andgets $ for mileage will be required to submit a consent form to pull report annually on the employee's date of hire birthday each year. His DOH was july
If he has to drive as part of his work, the company could be held responsible for his conduct. Thus, it is well within...
If you go to trial for a DUI and are found guilty, do judges tend to sentence the defendant with harsher penalties?
If you go to trial for a DUI and are found guilty, do judges tend to sentence the defendant with harsher penalties than if you plead no contest or guilty? Just curious about experience that clients and lawyers have had. Thanks for your responses.
Generally this is not held against you and in theory it should never be used against you when you exercise your trial...
