I was arrested and charged with a DWAI in NYC in 2010 it was finally plead out in the end of 2011 due to the prosecutor missing court for quite awhile. I got stopped and charged with a DWI in the middle of 2012 but they are trying to put me in jail for 45 days, I feel like this may be extreme, I have been reading this site and have seen that 2 DWIs means definite jail time, but I was under the impression that the DWAI doesn't count as a DWI and this would be treated as my first, I have hired a lawyer and only went to court once so far I have to go back on 7/26, Is it likely they reduce my sentence i have gone to counseling and am fully employed ?

I received a DUI last year and I'm on probation. I've received travel permits to travel for work around the US. Me and my fiancé are hoping to be married over seas where most of our families lives. My probation was suppose to end in March because of good behavior, but now my PO told me I have another year. I was charged with a DUI last year and I am currently on 3 years probation (first and only charge on my record) I have done zero jail time ever and only had to attend a DUI course and a pay fine. I don't meet with any probation officers, I just have to fill out a letter they provided and mail it with a copy of my pay stub every month. My record is great besides this blemish. I'm a working US Citizen and I'm engaged to someone on a working visa, I plan on being wed within the year. I wanted to know—would my DUI/Misdemeanor charge have any affect on her paperwork when applying for citizenship as my wife? Thank you in advance.

To make a long story short, I was going through a bit of a rough time in 03/09. I ended up getting arrested on a disorderly, and also got written a citation for an open container - both by the NYPD. Disorderly in Manhattan, citation in Queens. For the disorderly I gave my employer name and address, and when released after booking, they summoned me to "sign up" for 3 days community service, but I had to get right back to work (50+hr week) Honestly, I tried to get in touch with someone but just didn't have the time. Also I lost the paper ticket for the citation. Both "issues" happened when I was still carrying my old Florida driver's license. I have a NYS license now, and I wonder how "severe" this will be if they run my plates. I want to clear this up, too. What's the best course of action?

Was arrested for public intoxication and indecent exposure back in late 2005 . Accepted an ACD in Queens and was told the whole situation would be wiped from my record in a year or so as long as I stayed out of trouble . To my surprise , it was brought up by the public defender when she was gathering information before I went to see the judge after my arrest . From what I've read around the web , the prosecution can open the CAD if they want . Can this be used against me in my upcoming case ?
