Five years ago when I was 19 I got in an accident after drinking and injured my passenger. They postponed the court date so I could keep my license, as I was driving to college and work at the time. Now, five years later, my lawyer called me saying they want to bring it up again. I now live in another state, graduated with my bachelors, and have a full-time job of which I have no time off. How is this not a violation of the statute of limitations? Or at least a violation of my right to a speedy trial? There is no way I can travel 14 hours to sit in traffic court for something that happened so long ago.

Nebraska DMV has my license suspended due to the fact that they are requiring an sr22. NY state does not require sr22 so therefore one cannot be filed from NY out of state. I received my first DWI over a year ago, when I was 20. I went through the DDP and gained a conditional license. I was stopped last night leaving a bar for inadequate lights. I refused the breathalyzer test as well. I received 4 tickets. One for driving outside of the conditional restrictions, one for DWI, one for inadequate lights and one for refusing a breathalyzer. Do you think I could go without a lawyer and still avoid jail time? I will most likely get a lawyer though.

My adult son was arrested (later released) (NYS V&T 11924) after he hit another vehicle and the passenger in that vehicle sustained a personal injury (not serious). He had to surrender his license at first appearance on November 18, 2009. He went to two court appearances and was told the case has been sent to grand jury to see if this will become a felony indictment. He is currently in a rehab drug center. He was told at last appearance in Dec to return today Jan 6, 2010 but he was not on court calendar. His Public Defender told us he is not sure of the status thinking it has not gone before the grand jury yet? Wonder what is next? Should he hire a lawyer?
