1st offense OWI , non reporting . 11 out of 12 months completed , no issues . I had to make a trip downstate on short notice . I had to leave the next day so i called my PO and left a voice mail but no reply . I made it to event which lasted lit after midnight , called testing site and found out i had to do a urine screen in the A . M . So I stay up all night , drive 6 hours home on icy roads just to make it to my scheduled testing site . I was so focused on the safety of my passengers and staying awake , it turns out the restriction on the amount of liquids i was consuming was the last thing on my mind , all the red bull and water i drank to keep me alert and awake resulted in a dilute . i have nothing to hide , but fear for the worst . . . any advice on what to expect ?
Don't wait to find out how bad it may be, go and hire a local defense expert attorney who can help prepare the defense...
I have been convicted of minor with BAC (zero tolerance) around 10 years ago. I know in order for them to charge you with second offense it has to be within 7 years, however, if I get convicted of my current charge, which is OWPD and I god forbid get convicted of another DUI would I be subject to a 3rd Offense DUI (Felony).
In NY, 10 years is the significant. There are excellent attorneys in Traverse City that can help you.
In 2003, I received a DUI in California...however, I explained to the officer that I was in the process of moving back to Michigan the following week. At this point, the officer decided not to arrest me, allowed a friend to pick me up and take me home. I moved back to Michigan as planned, hired a lawyer, payed my fines and completed 16 hours of community service. "Nothing changes, if Nothing changes". I received another owi in 2007 & 2009. In both cases, nothing from California surfaced...so I didn't offer the information. Thanks to AA, I am in long-term recovery and have been sober over 2 1/2 years. I am eligible to request a hearing with the SOS to reinstate my driving privileges. Should I divulge the information re: California? It asks on the paperwork of any other 'convictions'.
They may find it through the national registry even tho MI is not in the Compact. Registry is a dupifferent deal.
In October of 2011 I was convicted of a DWI in MI and am planning on moving to AZ in the Fall of 2013. I have been looking for jobs in my field but of course most want your DMV record for the last 3-5 years and with my DWI I do not qualify for most if any jobs. However I have done some research and found that there is an association known as the "Interstate Driver's License Compact" that 45 states participate in, in which driving records and convictions for DUI's are shared. However, I found that MI is NOT a member of the DLC and was wondering if that then meant that once I apply for an AZ license my MI DWI will not show? I know it may show on a background check but I already obtain a valid AZ fingerprint clearance card in AZ that is valid through 2017 and I talked to the AZ Department of Public Safety and they assured me that as of now and until I have to renew my fingerprint clearance card if ever, I am "clean". Therefore, my DWI does not show in my AZ background check and now I'm just wondering if due to the DLC it will show on my driving record? Any information or guidance is welcomed and very much appreciated. Thank you for your time and help in this matter.
Yes. The national database will get you. Happens to people in AZ who have run away from an IL DUI all the time.
I was put on probation for the DUI and ordered to do the DUI classes I never went and seen my probation officer so I was picked up on a warrant they then gave me three months in jail and terminated probation but they never told me if I still have to do the DUI classes and other stipulations that were in the probation.
I would advise you to contact the Department of Motor Vehicles in Florida to discover what, if anything, is still...
I applied for a court appt lawyer and was granted that request. If all that is going to happen is that the Prosecutor and the Attorney are going to meet am I required to attend?
Yes, you do have to appear because anything that is discussed b/w the attorneys needs to be discussed with you and...
Will I have to pay the $1500 if I violated a condition of my release? Also, I wonder how a judge can force a defendant to partake in drug screening weekly as part of a condition to a bond? That would surely violate my 4th Amendment right. Charge is operating with presence of drugs..
You will have to pay the $1500 if you fail to appear. If you otherwise violate your bond conditions you can be returned...
