My son violated his probation in the middle of November , a warrant was issued and he was picked up, we left him sit 17 days, then bailed him out because he still didn't have a court date I'm told 60 days is the maximum time to serve for a first DUI My son was just picked up again, apparently another VOP ( didn't know he could violate again ) Can they keep him in jail more than 60 days waiting for a court date? how does he move things along . His case is in Circuit court in Baltimore county, md his vop are for not showing up, no ohter rimes have been committed.
Your son should ask for a hearing date asap. The maximum sentence he could receive depends upon his sentence. Since I...
I recieved a DUI in WV Dec 2005. I recently on April 2011 recieved another DUI in VA. I was tried and plead guilty for first offense dui in VA. I paid a court fee, did classes, and paid the reinstatement fee April 2012. I heard I can petition to get my first DUI in WV expunged. I went to get the papers since I was between the ages of 18-26 it is possible to get it expunged. So, the question is should I spend $155 to try to get it expunged, or do you think they will deny it? Also if they find out I had a DUI conviction in VA can they back track and reverse the charges in VA to make it a 2nd DUI? The funny thing is I live in MD and netheir convictions have shown up on my MD driving record. I am just trying to figure this out since I am trying to get a government job? Thanks!
I suggest you repost your question in the WV forum. Why woulnd't you want to expunge something that can be...
I have a 3 part question. 1st I have a revocation of license by DMV for points for DUI per se in MD that I was found guilty for on 10/2010 how long does that last 2nd the Frederick County District Court of Maryland set a license suspension order for failure to pay fines on 2/25/2011 how long does that last. 3rd Can I get a CDL if I have been found guilty of DUI per se (Not in a commercial vehicle) if so how long do I have to wait? I have recently moved from MD to VA and just need to know when I can get a VA license so I can get a decent job.
You will not be able to get a Virginia license lawfully until all of your revocations and suspensions are completed...
He will be finished 3 years probation in October for dwi. He was caught driving on revoked license and was issued a ticket. Probation officer said she will not violate him until he has been charged. He has been able to postpone the trial for driving on revoked license a couple times now, but can't afford a lawyer yet. Can he request a jury trial at his next court date?
YES. The penalty for driving on a revoked license carries a period of incarceratoin of more than 90 days, and as such,...
I was placed on probation for a DUI and through circumstances, was also driving on a revoked license. All the other legal issues have been resolved but, I now face the violation of probation. I have completed the probation last month but this driv=ing occuren in August 2011
I would say DUI/traffic, as they would be familiar with how the judges handle these situations.
My father got a DUI about a year ago and has been following the requirements of his probation perfectly. He was told to notify his probation officer if he intended to be out of the state overnight. He contacted her and told her that he was going to Turkey in 10 days to visit me, his daughter, for my wedding. She said that he can't without permission from his judge. He was never informed that leaving the country was any different than leaving the state so he's a bit disturbed now. He quickly went to the to to file a request, but is it too late? He filed on May 19th and his flight is on May 26th. Is he going to receive permission on time? Or would it be okay for him to fly before receiving permission. His probation record is spotless.
He definitely should not fly without a court order in hand. He may expedite the process if he contacts the State's...
Last May I was given pbj, and sentenced to two years supervised probation in result of my dui in Maryland. I was required to and have already completed alcohol classes and community service. I'm almost halfway through my probation without any violations until now. After taking nyquil without thinking about it, I failed my breathalyser test. I have documents from the hospital proving that I truly am sick. They told me I have to return tomorrow morning. Will I be arrested tomorrow? What can I expect the judge to decide to do as result of my violation?
Your probation agent can tell you whether he or she will notify the judge. If he or she does, and if you have otherwise...
