Does the state's attorney automatically file the PTR or does this come from the community probation officer? Does the PO have the discretion to choose to file or not file a PTR? In my case, I am on probation for a DUI from 2 years ago. Recently, I received a public intoxication charge, which viloates the terms of probation. On instruction from my PO, I have scheduled a substance abuse evaluation and will undergo treatment if recommended. However, I have not yet to see a PTR filed in my case.

i got a dui on 1-1-12 and a second one on 1-14-12, but when the officer called in my information they said that i had a valid drivers licence. when he took me to the police station and ran my information nothing showed up for me having a previous DUI so he wrote on the citation that it was my first offence (i told him the truth, that it wasn't). I was in IL for a formal. We were staying at a Resort and had a total of 9 people (4 couples & 1 single) staying in our house. 3 of the 9 people staying were over the age of 21. On the 2nd night of our stay there between 4-7 18 & 19 year olds showed up just as we were about to go to bed & they had brought their own alcohol. The neighbors ending up calling in a noise complaint & the cops came. The cops asked all of us for our IDs & asked us if we had been drinking. Some of the kids that had come over (with their own alcohol) admitted they had been drinking. Everyone there who was under the age of 21 ended up getting a minor in consumption ticket, including myself (I'm 19). I did not take a breathalyzer nor was I seen within atleast 100 feet of the alcohol, nor did I admit to consumption
