I had given a ride home from a bar to 3 marines. Two of them had left the vehicle to go in the apt., coming back & forth to the vehicle, I had two open beers in the vehicle, and the keys were in the ignition. I was parked in my car in a private Apartment complex. Apt. security (I assume) called CHP. The CHP questioned me & had me perform sobriety tests. I believe I performed well on the field sobriety tests, but was not as honest or cooperative as the CHP officer would have liked when being questioned (the boys stories differed /mine). CHP said I could have been DUI at the time I drove there, so he arrested me and took me to be booked where I submitted to a breath test which was a 0.06 result. I cannot afford pvt. attorney. Can I trust a Public Defender to get charges dropped in this case?

I crashed my car on a rainy night last month. Someone who saw called the Cops and they showed up sometime later, took me to the hospital because I got hurt. The officer waited for a blood test and CT scan and left when they said I had to be hospitalized. Got a Hearing from the DMV but they had to re- scheduled. Went to court this morning for my Arranaignment and told I'm not in the system. Referred to call the DA, they said they did not get anything for Me. I Don't understand what I'm supposed to do next, wait, call someone or What?? Also I'm not sure if it matters but I was thinking it might be taking longer because while at the hospital I was rambling on from being in shock or something and the cop Threatened Me, I also told the staff about what he said in his presence. My question is 3 parts: Part 1: I am paying this attorney in monthly installments can an attorney drag this out until he is paid in full. Pat 2: How long does the state have to charge me....I was stopped at a checkpoint I wasnt doing anything illegal that caused me to be stopped and then tested. So now other tickets pending Part 3 if the state doesnt file and the attorney didnt have to do anything should I get my money back minus the work he did in getting my license back.
