Could I go to jail?
I had a dui in 2008 and went to diversion, completed everything and it was all taken care of. I got a second dui in 2012 I paid off all my fine with bail money but I failed to do the classes and community service. Yesterday I got pulled over and got charged with dws and was arrested for a warrent I wasn't aware of. I've been bailed out for 2500. I'm just wondering if I will or how much jail time I'll have to serve. I want to avoid this at all costs. I just got into a medical school for my career. What should I do to avoid any jail time? What are the best options I have from here?

I recently received a DUI while visiting Oregon state on wendsday. (I am canadian )
I was on the side Of the road putting a address in my gps. Springfield police pulled up behind to ask what I was doing. They smelt beer on my breath and did roadside test and arrested me for dui. I did not blow and coperated the whole time. I posted 1500$ bail and requested an attorney. I am now back in canada and have a court date set for dec 16th... What are my options ? The arresting officer also called me last night and told me he had filed out paper work wrong and that new paper work would be sent to me. He checked the box that I had failed the breath test. But in all reality I did not do a breath test. How will this affect my canadian drivers licence? is there point to fight it ? Or go with diversion? and can I do that being in canada. ?

Is it grounds for a DUI when taking a person into custody for being intoxicated but not driving?
My friend was arrested for a DUI; however, he was only in the car looking for his credit card when he was met by the police. My friend was intoxicated, but he was not driving nor did they have the keys in the ignition at the time. Therefore, is it legal to have been taken into custody for a DUI?

Question Regarding DUI after applying for DACA
A friend of mine made a horrible mistake and has a court date for a DUI. He already applied for DACA Prior to his DUI ticket. The DUI did not involve any injury or damage to property. He had a Prior DUI charge which was dismissed. Can he be deported when they begin to do the background check on his DACA? Should he seek consultation from his Previous Immigration attorney? I told him to contact a local DUI attorney to see if anything can be done regarding lowering his DUI charge if possible. Thank you.
DUI can be a problem when DACA is up for renewal. Talk to an immigration lawyer for review of the record.
