About 8 or so years ago I got an underage drinking charge, my BAC was .03 i belive? Anyway I paid my fine and lost my license and its been in the past until now. I recieved a DUI and waived my rights and applyed for ARD. I have my CRN next week followed by my arraignment in Bucks County. What should I expect, will I know if i am accepted into ARD? Will this previous charge of underage drinking hurt my chances of getting ARD?
The old summary offense should not prevent you from getting ARD. The BAC may be relevant along with your license status...
old and is a Type 1 DIabetic; he became very overwhelmed and was having high anxiety and made an attempt to cut his wrist. I took him to the er where they stitched him up and put him into crisis care management. He volunteered to be hospitalized at a dual-diagnosis clinic for a 72 hour observation period. According to the tier, he is facing 90 days incarceration this feeds the anxiety (and depression) further. I support DUI laws, but am fearful that he will either try to harm himself again or just leave. He is a very good man; his health and job loss along with his Type I diagnosis (a few years ago, leaves him fragile. I don't think my county supports house arrest - is there any path to pursue to avoid so much jail time? Thank you!
Unfortunately, if he is convicted then the judge must impose a mandatory minimum 90 day sentence. House arrest is very...
I am traveling with my three brothers and my parents to Ireland in a little less than 9 weeks. I was sentenced to six months probation for a DUI in Pennsylvania that begin in March and will last until early Septmeber. I am in ARD and this was a misdemeanor not a felony. I contacted the Consulate General of Ireland in NYC and she advised me to contact the Police Dept. in Ireland to inform them of my wish to travle and my schedule. She seemed pretty confident that I will not have any problems. Has anyone had success in traveling to Ireland or abroad under these conditions?
This is a question for an Irish attorney to respond to. You may wish to post it under international law may be someone...
I am a 20 year old male and I was charged with a DUI in Montgomery County, PA (First offense) as well as an underage drinking charge. This is my first offense of any kind. I am a full-time college student and have a part-time job. My Preliminary arrainment and hearing are a month and a half away and I would like to meet with an attorney prior to going to court to discuss my options (ARD, etc.). I am currently living with my parents, however, they are not willing to pay for a private attorney, which I completely understand. Would I be eligible for a public defender based off my finances alone?
You would have to apply for a public defender in Montgomery County to make sure you qualify. Call 610-278-3000 and ask...
I was recently charged with 75 $ 3802 $$ A1* (lead) DUI: Gen Imp/Inc of Driving Safely- 1st off and 18 $6308 $$ A Purch Etc Alcoh Bev by a Minor in Montgomery County, PA. I am 20 years old and was driving my car after drinking. I got into an accident and hit a street sign and the curb. I was not injured nor was anyone else. Officers arrived and asked me to complete field sobriety tests, after failing the walking test, I was placed under arrest and was taken to the hospital and had blood drawn (no breathalyzer). This is my first offense of any kind with the law. In my summons I was not told my BAC and still do not know what it was, I was only charged with the 2 charges above. What are the potential penalties I face with these charges?
You have some options including applying for ARD, my suggestion is you retain a criminal defense attorney to help you...
This was my first offense. There was an accident, but I was rear-ended. I did not cause the accident (other than I stopped for some deer). I was accepted into the ARD program with 6 mos probation, no license suspension and no Drug & Alcohol classes. CRN concluded there was no drinking problem. My insurance company dropped me and the quotes I am receiving are insane!
You will be entitled to expungement once you complete the ARD program. With regard to the insurance issue, they are...
