In November I got arrested for a dui, but when it came to court time the case got dismissed and all charges dropped. The only thing I recieved from the dmv was about interlock, not about revocation. I went to the State Police to get a one way permit on my motorcycle, they wouldn't give me one, and went I went outside they arrested me because "they had me on camera pulling in" for driving on a revoked. If all my charges were dropped, and I was never convicted, why is the license revoked? Prior to that dui night I didn't have a WV license, I'm only here because I'm a full time student at WVSU, I have a valid FL license. today I got pulled over on the road I live on and the officer said it was revoked, and was going to send me a court notice in the mail. After attending all required classes, paying fines and fees and having FL license re-instated after moving to WV and attempting to transfer license they have now been suspended for 10 years. DUI in 1985, 2002 and FL in 2010 considered 3rd offense now although charged as 1st in 2010. How to transfer to WV?

In West Virginia; Kanawha County Magistrate Court specifically, should defense counsel move to dismiss a DUI charge if the arresting officer is not present? I would think yes, but I do not know the W.V. Rules of Criminal Procedure well. I would assume the State could move to continue, correct? In addition, could not the officer simply re-charge the Defendant by making a new complaint to a Magistrate Judge?
