My husband suppose to get out on Nov. 13, 2013 but idoc is stating there was no credit days on the mittimus so they are going to run it consecutive. The record office is saying it say concurrent but no credit days. I thought that would be automatically issued since it run concurrent with his other case. If credit days matter how do I get the judge to add it to the mittimus
An attorney can motion the case and correct the mitt.
Im not sure what to do? The department of corrections will not honor my fieonce concurrent sentence.
My fieonce took a pleas with the state attorney for a aggrav. Dui. He was issued 2yrs with a 1 day credit that he sat in the champaign co. jail. In additon, the sentence imposed is to run concurrent with the case that he is currently serving time for in the illinois department of corrections. However, IDOC is not granting the concurrent time they only gave him a 1 day credit and not running it concurrent to the case he is on now. They are forcing him to spend another year in jail. The mittimus states all the correct information. Please help. thanks Thank you,

Is there a chance for less than a conviction if I got a DUI and blew .18? No criminal history, clean driving record.
I have never been in trouble before and have hired an attorney. He is treating it like I have already been convicted. We have been to court once and will go again next week. He says I need a BAIID and do 100 hours community service but the judge has not sentenced me yet. Is he even trying to get me less of a sentence if he is telling me to do those things already? He doesn't explain anything to me and acts like I'm bothering him if I ask questions. If he isn't working FOR me, should I get a different attorney? My next court date he says he is going to ask for a continuance....why? I have done my assessment, finished one class and starting the next. So I am getting things done that I am supposed to. He claims we will be going to court several more times and it will be a long process. Help!
You need to ask yourself if this is a case you want to fight or is this a case you want to plead to and be done with....
I legally smoked cannabis in WA state. If I am pulled over in IL while sober, what are my options regarding implied consent?
There is no evidence of alcohol or cannabis in the car and there was no reckless driving. I am asking in regards to situations like being pulled over for rolling a stop, having a technical malfunction (busted tail light), and/or being a 20-something driving on campus at night. I have a previous drug case that was dismissed after completing first-offender probation. Should I refuse a chemical test if I am asked to take one?

Now I know I need to get an alcohol assessment done. Is there anything else I can do before I go to court to show them I will never commit this stupid offense again so they may consider court supervision? Such as alcohol awareness tests online,dui school, voluntary work, I mean anything at all???? first and the last time I ever drink and drive and I wanna show em that... I just know I screwed up and I wanna do stuff that may help me out before I get convicted of this dui... I know it's gonna happen but I at least want it to be a little less harsh than normal.
Hire a traffic court/DUI lawyer, and let him or her do all of the worrying that you are now doing.
Is there a good chance I can get court supervision if I offered to pay the full fine amount ,do 80+ hours of community service, take an alcohol awareness test online, and take driving courses??
While you may have a chance at supervision, this is not the sort of case you should attempt without legal assistance....
