My husband was the passenger in a vehicle involved in an accident, which was not the driver's fault. He lied to the police about who he was because he had a month old warrant out for his arrest for missing a DUI court case. Both are class 4 felonies. He only has 6 more months left of his 24 month probation. Both charges are being tried separately and I don't have any money to bail him out. How long will he stay in jail approximately with a public defender? The sentence for the DUI was 3 months in custody and 24 months probation back in 2011.

I was pulled over for speeding in Kendall County, IL, after which I was asked to submit to a Field Sobriety Test. I remained calm and polite while acting in this, followed instructions, and acted to the best of my abilities. Due to the circumstances surrounding the issue (40 MPH cross-winds, my shaking based on the weather and my nerves), I was taken in to the station, in which I continued professionalism before agreeing to submit breathalyzer. The officer gave me 20 minutes to sit without coughing, touching my mouth, or belching (Avoiding coughing was impossible, as I was sick). In the officers' statement, the coughing constituted as a refusal to blow. What are my options, and does this circumstance constitute my "admission of guilt"?

a) With my DUI conviction being “VACATED”, would the revocation (which was issued as an effect of the conviction still be upheld when I was arrested on 09-21-2012) still be in effect from 08-08 (issue date) to 10-04 (date vacated)? b) Since my conviction was “vacated” and my statutory summary supervision case was “terminated”, would I still need SR-22 insurance? My friends court date isn't until April 2nd. I am wondering if she should get the interlock device installed in case things do not go well in court. I have heard that she has a limited amount of time before she cannot enter into this program. Is this true? If she does get the device and she is then found innocent can she get her money back? Will she have to continue paying for the device?

I'm 4 months into the 6 month SSS. I am driving on the MDDP right now. Havent been convicted of DUI yet, but expect to once I run out of continuances. Second DUI. First one was 8 years ago and got supervision. Question is, am I eligible and should I hire a lawyer and try to get RDP as soon as my revocation begins, or wait until the year is almost up and try then. As far as I can tell, the cost is much more to try and get the RDP within the year than it is to wait until the year revocation is up. I live in Naperville and getting to my job would be tough, but not impossible.
