I was arrested for a 1st time OWI in Michigan but am a resident of California. It seems many 1st time OWIs in Michigan are plea bargained down to a OWVI. The OWVI seems to not require a blood alcohol level above .08 but just notes the driver was impaired. If I accept a plea bargain to the OWVI will California interpret that as a "wet reckless" charge or a DUI? And is it dependent on related information (blood alcohol reading, speed, etc.)?
Michigan is one of 5 states that does not share information through the interstate compact agreement. That just means...
I want to join the armed services with a secret clearance requirement. The problem is that I have a dui (marijuana)/poss (marijuana) diversion. This took place in Oregon but I live in California. At that specific time I was going to college in Washington. Will this be likely to show up on an FBI background check?
If you were fingerprinted and photographed following the arrest, most likely.
Other than this DUI I got 7 years ago, where I just went in and pleaded no contest and was convicted , I completed all the classes and fines etc that the court required. Since that time I have received my Associates and Bachelor Degree, has anyone heard or handled a case with an expunged DUI and has been granted Deferred Action ? Your guidance is much appreciated.
My guess is yes, but I don't know of any hard rule one way or the other. One of the requirements for Deferred Action is...
I am a minor with only a driver's permit in California. I crashed a car and took a breathalyzer test, my BAC was .02%. I was cited at the scene of the crash for driving without a DL, and DUI. In court, the DUI charge was dropped because of special circumstances. I was given probation and community service hours. The DMV says I am not able to get my license because they were only notified of the first citation, nothing more. I am planning on appealing their decision. Any advice or things to expect would be greatly appreciated. Thank you
If the DMV suspended your license at an admin hearing you should hire an attorney to help with the appeal process and...
My uncle, who is undocumented, was pulled over on Saturday for driving under the influence. After being tested, he also came out positive to Marijuana. It is his first DUI and there was no one injured nor an accident. We're still awaiting court on Tuesday, but would like to know what is the best way to handle the situation.
Always better to err on the side of caution. A short visit with an immigration attorney doesn't have to break the bank....
1st offence, no prior record. I had the blood test but do not know what it was, but the officer said he was sure it was over the limit because the breath analysis at the scene was high.
Yes hiring an attorney will help. You are going to be prosecuted by the DA and also the DMV. Make sure you contact the...
It will be three years in May and I was wondering if I had to keep paying insurance since I do not own a car. I understand that if I stop paying now, my liscence will be revoked.
3 years on a 1st DUI. You should double check with DMV to confirm when the requirement is up.
