I received my first DUI about a month ago. I just received my BAC results of .19. I am under the age of 21 and unfortunately got into a car accident. I was the only person involved in the accident. I requested a DMV hearing and was able to extend my license until the hearing date. However, I'm curious as to how difficult it will be to be able to obtain a restricted license to and from work? I blew under the limit and the DAs office dropped the charges against me for a first time offense DUI with no record. Will I need a lawyer to expunge the arrest? How long will the process take? Since charges were filed, it looks like I cannot expunge through the police dept. The judge didn't do anything for the expungement and the DUI charges were actually lowered to an infraction. I was arrested in Van Nuys on suspicion of DUI. I asked for a blood test, so I was immediately placed under arrest. On my DMV temporary license the box ix marked 0.08% or higher, but I don't know the actual BAC. I stopped by the CHP today to request my arrest report and they told me I need a public defender to access it sooner than 2 weeks from now. My court date is 3 weeks from today, so when do I speak with a public defender? Do I need to register? I have no priors, but its obvious I will be convicted so I really don't see the point unless I was 0.08 or 0.09, in which case I would consider a lawyer. But I need to know soon so I can make a decision.

I blew well under a .08 and it seemed like the officer debating whether to arrest me. Long story short, I got arrested and my license was not suspended by the DMV since I blew under .08. A lot has to be taken into consideration, including all the small and big facts but I think I have a good shot at a case dismissal, first dui, clean record. Would I be told after the arraignment or at the arraignment if say the case does get dismissed? Also, can the prosecutor call witnesses into court without my approval or my attorneys approval? What kind of questions might the witnesses be asked? I'm concerned since I do not have a good relationship with the people I was with that night.
