He said I did not blow right and put me into the car. I was not drinking. He also thettened to taser me. I was respectfull and done everthing he ask of me, He took me to jail, and I spent 8 hours in jail. never read rights andhave on idea what I blow or I charged with. I received around $2500 in court fees and fines, and a jail sentence of 21 days in August of last year. My fees/fines are due 2/11/2013. Since my release from jail I've lost my job, and have been looking ever since. I recently moved in with some friends close to town to increase the likely hood of finding a job, although it is still very hard due to my lack of a drivers license. I've had a couple of interviews, but I've failed the background check every time. I'm expecting a little over $1000 in tax refunds and plan to use all of it to make a payment on my fines. Considering this, what can I expect when I go to court on the 11th of next month? Is there any way I can avoid jail time?

The story - Had 3 beers and shared a little margarita over the course of two plus hours.Took my friend home and as i pulled into the driveway I was bluelighted. Told I failed to come to a complete stop at the sop sign (which as memory serves I very much did) and failure to use turn signal (which I didnt (it was residential)). Told me my eyes looked glossy, asked me to step out...and lets do a field sobriety test. I (regrettably) told him I believed the test to be waste due to his biased opinion but complied. drug test says I had 500 ng/l oxycodone (prescribed 6 30 mg per day) and 40 ng/ml Xanax (prescribed 1mg x2 a day) and it also said I had amphetamine which I suppose is like adhd medicine but I do not take that so I don't know why it showed up. the amphetamine did not register how many ng/ml there was. would it be possible to get it amended to a lesser charge?

Busted my head on a rock and suffered a nasty head injury, the police were called by a friend when no one could find me, the police found me and took me to the hospital and had my head treated, I signed the BAC consent form while there but honestly had no idea what I was even signing. I had drank directly after the accident and know my BAC is slightly higher. While questioning my family that were I'm the room I learned the lab tech had cleaned my withdraw site with an alcohol swab instead of iodine, I've heard this can greatly change test results. My main question is, can I be held responsible for signing that consent with my head injury?
