Hi, I have my first DUI in GA with BAC of 0.18 and am charged with DUI on March 7th 2012. I am on unsupervised probation till March 7th 2013. My current H1B expires in 1st DEc 2012, my company will file for H1B extension in next couple of month. Will H1B extension pose any problems / issues is getting te extension? thanks
Is this your first offense? Unlikely it will affect your H1B extension as fingerprints are not taken for an H1B extension.

Hi, My company is refilling my green card process in EB2 and starting with the labor process again. also at the same applying for H1 Extension. My priorirty date is current so if the labor gets approved, I would have to file I 140 and I485 together. Below are the questions - 1. Will my H1 Extension be an Issue? 2. Will labor approval / I 140 be a problem in EB2? 3. Will I 485 adjustment be an issues because of DUI, which would be filed in next one year? 4. Can I use external lawyer to file I1485 and my company lawyer will file I140, as I understand that I have to mention about my DUI and I dont want compan lawyers to know about it. Does this sound like the correct process? Any further tips? I got a Public Intoxication and I want it dismissed. From what I've gathered, I will need to: 1) I will ask for deferred probation. (I should NOT plead guilty or even no-contest) 2) I will complete deferred probation, complete what is requested of me, and get it dismissed. --- Now my goal will be to get it expunged: 1) 6 months after dismissal, I will get fingerprinted with L1 and obtain my criminal record. 2) I will complete the Expungement Petition that I found here: http://sites.lawhelp.org/documents/clusters/TX/443/English/1_Expunction_Petition_Final.pdf 3) I will bring to the courts the completed expungement form, copy of my criminal record, proof of completion of whatever I was assigned, and copy of my ID.

I was even issued a new license at the DMV more than a week after my DWI arrest. Am I at fault? My drivers license has since been reinstated. I notified the DMV of the dropped charges.
