Can I use a special defense for my OWI refusal hearing? (Please note I have a lawyer but want some additional advice)
I was arrested for OWI in Dec '12. The cop says he smelled marijuana. I passed several tests and could not perform some one leg tests due to a medical condition. I did not fail any tests. I was arrested and told that they would draw my blood (found a gram in the car, not my car) due to red. At this point, I felt this was unreasonable search and seizure and extremely intrusive and told them I refuse my blood being taken. I read if I refuse they have to get a warrant from a judge who I felt would listen to the facts and surely deny this, since the cops weren't being objective. They didn't get a warrant. I know that is big for the OWI case but do I have a special defense for the refusal hearing? Please note I have a lawyer but want help from the collective thought power of this site.
