I was charged and arrested for a first offense OWI in Indiana not too long ago. I hired a lawyer to help me with the case but he is telling me that without spending between $7,000 and $10,000 I would not be able to hire a toxicologist or have money required to cover the deposition and witness fees to obtain facts to defend my case. A plea bargain was presented that I don't think is fair: jail for 7 days or a three month class, one of which I cannot drive to and from, nor could I redeem my license until after the course is completed. I don't live in the place I was arrested, but an hour away thus making that class pretty much an invalid option. Since jail would be bad, are there no ways to defend oneself without having to be wealthy. I would just like to get the plea to be more reasonable

I was charged with OWI a month ago. In the county I was arrested in, they have a blanket bargain agreement for these types of cases where you get 14 days in jail OR complete a 12 week intervention course - and on top of that the person STILL gets convicted. Considering my record, it's hard to believe I deserve such a harsh a punishment - It's my first offense mind you with no previous anything on my bill other than a speeding ticket. Anyways, what in the world can I do about these circumstances? 14 days in jail is obviously terrible and the 12 week class must be completed in THAT county! I live an hour away. Besides accepting this cruel punishment, what can an honest person do to defend against this level of absurdity? I hired a lawyer, but he seems uncreative about the options.

I was driving home a few days back when I was stopped for what the officer said was 'driving through a barricade'. He said there was a tree down across the road from a storm and asked me why I did that. I didn't see a barricade, it was night, and it was pouring rain. This is not a city street where you can take the next street over to go past either, this is a town road where the next detour is miles down the road. Anyways, The officer said he smelled alcohol and had me do the field tests, it's still pouring mind you. A friend was pulling out of a parking lot and bumped some beams that was stacked up in the middle of the lot and pulled right back where it came from and them took off. this was my car and the e-break needs to be set or it will pop out of gear. i slid over set the break and left the motor running because it was cold. i was trying to get my phone going and looked up and there was a officer standing at my window. i shut the car off and the officer took me to jail. i remained silent as my right. i live in indiana and i recently got arrested for a dui and they also charged me with neglect of a dependant because my son was in the car. i wasnt actually driving the car it was parked with two flat tires because my sons uncle cut them. i passed all the field sobriety tests but i blew a .10 on the Breathalyzer and the legal limit is .08 now cps is involved. i havnt met with them yet but im afraid that when i do their gunna take my son. i dont know how to fix this huge disaster. plz help me

I am on probation is marshal county located in Indiana for a DUI misdemeanor offense and was sentenced to 1 year probation, classes, 1 year jail suspended and license suspension. I completed alcohol classes and only had about a month left on probation and I managed to get another DUI in Elkhart Indiana while still on probation for the previous and this time it's a d felony .

At the top of the Affidavit of Probable Cause it says who the arresting officer is, gives a description of my vehicle, describes my race, etc. Then says that the accused was observed at Dunes State Park operating a vehicle. Yet none of the Preliminary Observations boxes are checked and no reason for stop was explained. Under Accident Information it list 1 vehicle was involved. Minor damage was reported to my own vehicle. Truck was stuck in the sand, w/ the back end off the pavement. In the police report it says that the officer was approached by male subject (me). Being that the officer was approached should indicate that I was outside the vehicle, keys in pocket. Truck was stuck in the sand, off the edge of parking lot. Does saying I am the driver admit guilt? Does officer have true PC?
