I was 20 at the time of the incident, and the man was 4 years my elder. He got me into a 21+ bar and bought me numerous liquor drinks & shots. We had sex, though I was blacked out and only remembered pieces of the incident afterward. I became pregnant and only then did I figure out exactly what had happened that night after being told the exact events by the assailant. I received an abortion the following month. I never filed a legal complaint as I did not identify as a rape victim and because I stupidly trusted it was not a malicious crime. Only now, I suffer terrible anxiety because of the abortion and out of fear the assailant will tell friends and family about it. Also he was on felony probation at the time for drug related crimes.
Your age wouldn't be the deciding factor as to whether or not it was rape. Based on the facts as you tell them, it...
I was arrested with the charge of underage consumption . I was at a party where a person was arrested outside ( everyone else was inside besides home owners who were 21 ) who was under 21 ( above 18 ) for being around alcohol . The cops then arrested the house owners for contributing to minors ( which no one was , b / c we are all above 18 ) and that gave them " probable cause " to enter the premises . They arrested all the minors inside myself being one of them . I was thrown on the ground , sustained minor injuries ( bleeding from my shoulder and bruising on my back ) , was never read my rights , or Breathalyzer / sobriety tested . Simply taken to jail and charged . Is there anything I can do ?
Get an attorney. Sounds like the charge could be dismissed with experienced counsel or at the worst, you'd get...
I was arrested for suspected DUI. I have both a passenger witness and I believe their car tape that will substantiate I was not DUI. I need a "model" so I can produce a motion for dui dismissal. This is my 1st time before the judge and no plea has been entered yet. I will be representing myself as I am a 100% disabled veteran without adequate resources immediately at hand.
You should not represent yourself unless its an absolute necessity. You can get a public defender if you qualify for...

You should consult with a DUI/DWI attorney from Tenn for your answer.

You need to ask for a court appointed attorney. If you were not intoxicated, there is no way that you should stand for...
I planned on walking the few miles to my destination after having a few drinks at a restaurant when I left I was jumped and beaten outside I got away from my attackers and tried to get to Vanderbilt in my vehicle. I had a broken nose staples in my head and fractured neck. The officer said I failed the field sobriety test. I had head trauma and a broken nose how could he come to that conclusion
Given these facts I think you would have a good chance. You need to contact attorney as soon as possible
My son was out celebrating valentines day with his wife, they had an alternation, he left and went to a bar, he was there less than 5 mins, the police pulled him out of the bar and charged him with DWI. They asked him if he drove to the bar. He said "Yes." Then they arrested him.
The state must prove he was intoxicated while he was operating the vehicle. If they can prove that, it doesn't matter...
