I was 20 at the time of the incident, and the man was 4 years my elder. He got me into a 21+ bar and bought me numerous liquor drinks & shots. We had sex, though I was blacked out and only remembered pieces of the incident afterward. I became pregnant and only then did I figure out exactly what had happened that night after being told the exact events by the assailant. I received an abortion the following month. I never filed a legal complaint as I did not identify as a rape victim and because I stupidly trusted it was not a malicious crime. Only now, I suffer terrible anxiety because of the abortion and out of fear the assailant will tell friends and family about it. Also he was on felony probation at the time for drug related crimes.
Your age wouldn't be the deciding factor as to whether or not it was rape. Based on the facts as you tell them, it...
I was arrested with the charge of underage consumption . I was at a party where a person was arrested outside ( everyone else was inside besides home owners who were 21 ) who was under 21 ( above 18 ) for being around alcohol . The cops then arrested the house owners for contributing to minors ( which no one was , b / c we are all above 18 ) and that gave them " probable cause " to enter the premises . They arrested all the minors inside myself being one of them . I was thrown on the ground , sustained minor injuries ( bleeding from my shoulder and bruising on my back ) , was never read my rights , or Breathalyzer / sobriety tested . Simply taken to jail and charged . Is there anything I can do ?
Get an attorney. Sounds like the charge could be dismissed with experienced counsel or at the worst, you'd get...
I was arrested for suspected DUI. I have both a passenger witness and I believe their car tape that will substantiate I was not DUI. I need a "model" so I can produce a motion for dui dismissal. This is my 1st time before the judge and no plea has been entered yet. I will be representing myself as I am a 100% disabled veteran without adequate resources immediately at hand.
You should not represent yourself unless its an absolute necessity. You can get a public defender if you qualify for...
Arrested for DUI. I was weaving (dropped items in the car and weaved) and also failed portions of the field sobriety test (eye test and one balance test). I was extremely nervous. Never experineced anything like this before. No alcohol and no illegal drugs in my system but I do take 20 mg of paxil daily. I told the trooper but do not know if he recorded this information or added it to his report for testing to use against me. Will the blood test look for this prescription med when testing? I have read it is possible to have a DUI arrest enforced even when prescribed medication is taken in its prescribed dosage.
It's doubtful they would detect the Paxil unless they specifically looked for it. In my experience, Paxil does not...
It is her 3rd DUI in 16 months - she refused the "deal" and now has court / trial next week. She has been running wild for 3 years - walked out on all 4 children ages 2-6 and puts on a great front in court... she always seems to get out of everything... failed drug tests while on probation, no place to live, bounces kids all over the place but DCS wanted to keep giving her chances.. meanwhile she got off probation in April, for the 2 DUI's and got 1 DUI and 2 driving on revoked in a few months - she never installed her interlock and continues to still drive the kids around... how do people like her keep avoiding jail and what can be done so she has consequences before she hurts her kids or others in her path....DCS was certainly was no help. if convicted, how long till she goes to jail
I doubt she'll walk away from this. Keep in mind though that we are criminal defense attorneys here and not...
Previous DUI reduction was in Nashville, current DUI was in Tullahoma. I did not consent to the test for the first charge from 8 years ago and did not consent to the blood test this time either, however the officer obtained a warrant and blood was drawn. I performed the standard 3 roadside tests and the officer even said that obviously you are not slurring your words or falling down drunk but I believe you may be over the legal limit. The blood test will likely show that I was over the limit and there is a possibility that another substance may show up as well. My goal is just to retain my driving priviledges as i am pharma rep and drive for my job. If i obtain a very good DUI lawyer what are my chances of possibly being lucky enough to get another reckless plea. Any advice greatly appreci
Yes and no. The good thing about the prior reduction is that the current DUI cannot be classified as a DUI 2nd Offense,...
Was arrested for DUI in TN and refused chemical test although the officer obtained a warrant and I had to take one anyway. I feel that the results will show that I was over the legal limit and my also show another chemical in my system as well. I was told the blood test could take 4-6 months to come back and was wondering if it was possible with a good DUI attorney to plea down to a lesser charge such as reckless driving before the results of the test come back.
Yes. When I was a prosecutor, I would routinely plea cases before the blood was back. Will a DA do so with a prior...
