My daughter,19,had just finished her 90+90 day suspension as part of her DUI that she got in May 2012.She was (still is, I guess) on the ARD program, she took all the classes, etc.Her "eligibility date" to drive was Sept.30.Tonight,she just got cited again for underage drinking. She was walking home and got stopped on the street by the state police, they smelled alcohol, and of course, her breathalyzer was above the limit (0.02 for underage?). The trooper wasn't helpful with our questions,he said it would be up to the judge if she would lose her license again in addition to the fine.Is this true?We just paid off the first fine and were about to start the process of expunging her record.What will her record look like now?She had a useless public defender before,does she need a lawyer now?

My daughter, 19, was accepted into the ARD program (FIRST offense) in Feburary 2013 (she completed all her classes and counseling sessions and is paying her fine off monthly). She is currently serving the first of 2 - 90 day license suspensions. I understand the first suspension is for the ARD program, and the second is for underage drinking. The first suspension expires 7-3-13. She currently is working 15 or so miles from home and is looking to apply for an Occupational Limited License (OLL) to have during the second suspension so she can drive to work. Is she eligible for the OLL?
The answer to your question is MAYBE. The suspension imposed pursuant to to the ARD for DUI is NOT eligible for an OLL....

she was sentenced to 1 to 2 for 3rd dui highest level no other charges. Her original sentence had no mention of house arrest only elgiible to the dayreporting center after 5 months. She was released after serving 5 months in jail, to house arrest for the remainder of her minimum and must report to the new dayreporting center in Ebensburg everyday. others only have to do house arrest or day reporting? How and why? it does not seem fair. shouldnt she be doing one or the other not both? Shouldnt she only be doing 1 month house arrest not 7? cause 1 month would make it half her minimum.
