she was sentenced to 1 to 2 for 3rd dui highest level no other charges. Her original sentence had no mention of house arrest only elgiible to the dayreporting center after 5 months. She was released after serving 5 months in jail, to house arrest for the remainder of her minimum and must report to the new dayreporting center in Ebensburg everyday. others only have to do house arrest or day reporting? How and why? it does not seem fair. shouldnt she be doing one or the other not both? Shouldnt she only be doing 1 month house arrest not 7? cause 1 month would make it half her minimum.

My daughter , 19 , was arrested for DUI and some other charges last year . She is now in the ARD program for first time offenders . As part of the ARD program and being underage we knew she would have a mandatory 90 day license suspension . Two forms from PennDOT came today and she has not one , but two ! 90 day suspensions ! Two days after her hearing last month , she got a letter from the court saying that after we left the courthouse she was also charged with 6308a Purchase , Consumption , Possession , or Transport of Liquor , with a $ 50 fine and additional 90 days probation . Would this be the reason for the second license suspension ? Does this charge even carry a license suspension ? The paper I received from the courthouse says 90 days PROBATION . How hard is it to appeal this second suspension ?

This was a first offense DUI arrest for an individual with no prior arrests or charges...not even a traffic violation in 5+ years. The individual is a recent college graduate with an engineering job nearly 30 miles from home. ARD was brought up by the arresting officer at the time of the arrest.

Is it even worth fighting a first offense DUI case? Since they now offer ARD? I work at a local courthouse and it seems to me that the chances of getting a fair judge to rule on a DUI is almost impossible. Most of the people here refer to a DUI by court as "a extended guilty plea". Also since a first offense DUI offender cant get a trial by jury.
