My son was received a ticket for DWI on SEpt 28 and along with the charge, he received an appearance ticket for OCT 14. When we appeared in court, the judge advised that the charges were never filed, so there was nothing he could do. He told us to return on Nov. 10, As of Friday, Oct 31, the charges still have not been filed. Is there a time limit as to when the charges must be filed? Or do we just keep waiting month to month?

Im being charged with DWI Class e felony in NY. Ive passed all my drug tests gone to treatment. Im spending a ridiculous amounts of money on treatment public transportation mandatory classes . Plus Drug court makes you pay 1500 before you even graduate plus on top of the fines the will give me when it gets dropped to a misdemeanor. All drug court is doing is making it from a felony to a misdemeanor and causing me some serious grief. Can i withdraw from drug court and take it to trial? If I have a good lawyer can I shoot for a 6-5 split? I really am at my wits end with this program.

Attended a wedding in Lake George, NY. Stopped drinking around midnight. Next morning, pulled over around 11:30AM for traffic violation. Officer smelled alcohol (I had not showered nor brushed my teeth - dumb I know) and said I appeared "glassy eyed" (I have been traveling for work for 3 weeks, I was exhausted). Refused the breathalizer. Said I failed 3 out of 5 sobriety tests which I did not find out until I read the report, and I am positive I did not fail at least 2 of those said tests. Put something in my mouth without telling me what it was - twice. Asked 4-5x if I was sure I didn't want the breathalizer. How can I be convicted of a DUI when I had not been drinking for 11 hours?!
