Hello and thank you.
Charged with a DUI in January 2012 in Sacramento County; fulfilled safety education program and Interlock Device requirements before recently moving to Arlington VA. All restrictions were lifted from my CA license prior to moving.
I got my VA license 2 weeks ago only to have it revoked a few days later- with documentation citing my revocation will be lifted Feb 12, 2013 pending my compliance with Virginia's Safety Action Program (aka VASAP which may include an IID installation).
Will I likely have to repeat these similar requirements in VA which I have already fulfilled in CA? I would like to hear your input. Thanks!
Although states have different requirements, generally if alcohol classes or other requirements are accepted in one...
I blew a 0.07 on a military base while coming through the gate. I have a court date out in town in Alexandria on Apr 1, 2013 (2 months from now). What do I do now? What to expect from the civilian and military authorities? Can my command punish me before the civilian court date? Will I get a DUI or a reckless? I feel like 8 years of service just went down the drain.
Your command may initiate Article 15 (NJP) but as you were below the legal limit, you would have a valid defense....
I was in ASAP- paid $400 fee & taken 10 week classes, but still on probation - when I got the 2nd DUI. I wanted to quit, so I asked 2nd probation officer if I could enter residential treatment as my ASAP program for that county (Arlington). I had already looked into it & found program thru Fairfax ADS, since I was already on ASAP probation there. My Arlington County PO agreed. I thought since other program was Fairfax, that other PO would automatically know. I completed the residential treatment and have not drank since. When I tried to get my license 7 years later, I was informed that I never completed the program, since the Fairfax PO couldn't find me while I was in residential treatment. I have proof of being in treatment, but they want me to pay another $400 and start over
If ASAP says you need their clearance to be reissued driving privileges in Virginia, then in my experience there is no...
I received a DUI in the state of Virginia and am a resident of Maryland. I was sentenced to 3 days of jail, the rest suspended, plus probation plus mandatory VASAP classes. Because I live in northern Maryland, I chose to take my VASAP classes in Maryland. In the meantime, I received a traffic ticket in Maryland. Due to some flood damage, I temporarily stayed in a hotel and when I returned back home, I found out I had a "Show Cause Summons" for not reporting my ticket and that I was tried in absentia. According to the online district court case search, my sentence/probation is revoked but sentence shows 0 days and probation shows 0 days. I am confused as to what happens next? Is there a warrant out for me? Am I facing jail time? Help!
You need to call your attorney that handled the original part of your case where you were put on probation. Good Luck
I was convicted in federal court of a simple DUI. I have to deal with a Fairfax County ASAP probation officer as well as a federal probation officer until October (1 year probation). I have an ignition interlock device installed that I want to remove. It is coming up on 6 months with no violations. I have fulfilled all other requirements.
Contact a DUI lawyer in your area. The law mandates the IID be on the vehicle for six months. The court may require it...
I recently got a DUI charge in Atlanta Georgia and refused to take a breath test because I had one drink an hour earlier and none before that. I was surprised when I was handcuffed and taken to jail . I still kept my Va licence and was never read my Miranda rights or was offered to get another chance to take a breathalyzer test. I am worried about my va licence being suspended. What are the consequences I could face in Virginia?
If Georgia suspends an imaginary Georgia license then yes Virginia will suspend your license. You need to make sure...
