Can I be charged with a DUI if I wasn't given a ticket?
I was stopped late night by the police who gave me a field sobriety test (touching the finger, walking in a straight line, holding one leg up and following his finger with my eyes). It seems that I passed all of them. Then I took a breathalyzer test blowing 0.088. I maintained that I hadn't had a drink in several hours. They let me go without giving me a ticket (just gave me my license back) but called a tow truck and said I had to pay for the tow home. I was pretty scared so I can't remember clearly but I believe he said he could charge me but wasn't going to (perhaps b/c I was polite and cooperating). My question is, did I get charged with a DUI? Should I consult a lawyer at this time?
Sounds like you are pretty lucky on this one. Be more careful next time.
Can I get a Minnesota License?
I received a DUI in another state more than three years ago. I moved to Minnesota recently and I need to get a new license. All of the criminal charges in the previous state were dropped, however the previous state has laws requiring an alcohol class to get your license reinstated, which I never took before I left. 1. If I were to apply for a new license in Minnesota would that prevent me? 2. If so, what are my options going forward?
Probably not. You'll likely need to satisfy the other state before Minnesota will give you a license. Talk to one of...
Got charged with 3rd degree dui for not taking breathalyser test. had dui 12 years ago. is being charged as first . penalties?
was sober over ten years. have been struggling for couple months. going back to meetings now. was coming home from work parked at a park by my house(so i could walk home)and drank in car. got busted in car with car parked. but i don't think that matters at all under law.
Your charge is a gross misdemeanor and does not carry mandatory jail time, although some prosecutors will initially ask...
How do I clean up a clerical mess over a DUI in 1989?
DUI in GA, 1989. Jumped through all the hoops and left the state in 1990. Have held a valid DL ever since but when I went to renew in August 2012, I find out that GA screwed everything up and suspended my DL in 1990. They claim I owe them 20 hour DUI class (did it) and a drug/alcohol evaluation (did it) plus a reinstatement fee of over $200. Of that, all I did not do was the reinstatement fee because my DL was not suspended by the judge. How could I have held a DL for all these years, gotten tickets, was arrested in 2007 but never did my license come up suspended until now? I need to know how to make this go away. I cannot renew my DL, nor can I get a gov't issued ID until I clean it up. Please advise....

Why did I get my administrative penalty for "refusal to test", but still haven't gotten any criminal notice/penalty/court date?
At the end of Feb, I was driving drunk and hit a tree and was taken to the hospital. About two weeks later, I got an accident report from the police station that said that I admitted to drinking (while still on the scene of the accident), but when I was taken to the hospital that I "refused to test". Because of that, about a month later I got a notice from the DPS about my license being suspended for "refusal to test". It has now been a month since THAT notice, and a few days away from two full months since the accident. Why haven't I gotten any criminal penalties/court date, etc.? Is it possible I wont? (I ask because I don't want to go do everything I have to do to reinstate my license, including buying a new car/plates, etc, only to have new penalties, plates impounded, etc)
Charges do take some time to process. I would call the courthouse where the charge would be filed and ask them to...
Does Minnesota put Underage Drinking tickets on your driving record?
Not drinking and driving, just a couple underages (age(s) 19-20) by a dumb college kid. License was never suspended. Graduated now and asking because I have to submit to a driver's insurability assessment for a job. Offenses were civil infractions in the state of Wisconsin a couple years back, so not sure if MN knows about it or not, and if they do what do they do with it record-wise?
Why don't you just go to the DMV and request your history to find out? I am not licensed in Minnesota, but in...
Will MN take action against me once they find out I was arrested for another dui, but in another state?
Current resident in Mn. Also have two priors dated back 2007 and 2009. Recently arrested for an OWI (operating while intoxicated) in WI.
Yes, it's very likely that Minnesota will eventually revoke your license if you're convicted of a Wisconsin OWI.
