As long as it is 2nd within 10 years and you have no prior felony DUI, then this one can only be a misdemeanor....
My license was suspended 3/11 for DUI (.09). I had a 30 day hard suspension and was eligible for a new license on 7/12/2011. I went into the DMV today to get my restricted license and now I am not eligible for a new license until 9/12/2011! I called the mandatory actions unit in Sacremento and they told me it was standard practice to extend the 'suspension period' for a restriction on your license. I never read or heard of this before through my lawyer or other people in the same situation. Is this in fact a standard practice CA DMV does to all people applying for a restricted license? Is there any kind of recourse to remedy this issue? Thanks!

I am a seventeen year old in California, and will be going to court for a DUI of over .08 and reckless driving. I have already been on probation twice in the last couple years. The first time was for stealing beer, (it may have been considered robbery) so i was placed on formal probation for six months. My second time was for public intoxication and resisting arrest, resulting in 1 month house arrest and 1 year of wardship probation, but i was let off at six months for clean tests. What sentence might i face for the DUI? Will i be put in juvenile hall? What could an attorney do for me, and how much would one cost?
