If I am supposed to be working abroad and I don't have my court date until late February is there a way to start taking my DUI programs asap? is there a way to postpone the classes? and is there a way to push my court date up? I am supposed to be working abroad early next year and unfortunately this may cause a hinder :(. Any feedback will help. The main thing is I understand that the classes are at least 3 months for me being a first time offender. I am trying to do ANYTHING I can... This was the second time I showed up for court. Once from the ticket- no charges yet- granted it may take more than 30 days to get my case together. Then got an official DA letter 2 months later stating to show time/date and was not on docket? This is Alameda County. What is the issue? I was convicted of a DUI three years ago in California and recently filed to have my probation terminated early. While visiting family and friends in another part of California this past weekend, I was involved in a car accident. I was hit by another car and when the police arrived they performed a field sobriety and breathalyzer test on me. I was over the legal limit, but I was not arrested. The officers confiscated my license and drove me to my family's house just a few blocks away. I have several questions about all of this. Will the court that is handling my early probation termination find out about this before my appearance in several weeks? Will I be charged for a second DUI? Will I need to come back to the county that the accident took place to handle everything?

And one of the conditions is don't drive with .01 or greater. My question is if I'm pulled over for any reason can a cop just pull out a breathalyzer and make me give him a sample whenever he wants even if I'm not pulled over for speeding or swerving? Pretty much does he have to have a reason too breathalize me or can he just look on the computer and be like "oh your on probation I can breathalyze you whenever I want, even if I don't have a real reason"?
He has to have a reason to pull you over. I doubt that that condition of your probation is on the computer readout...
