My husband plead guilty to an impaired driving charge and was sentenced to do 48 hours of community service. The problem is that the judge ordered it though the city and he can only do community service on days that he MUST work or lose his job. He is the only working person in your home. We contacted the court to see if we could do the hours though a non profit instead so that he could complete the hours on weekends and were told that we must meet with the judge. Our docket date to meet with the judge is AFTER the date that he would have to have his community service done by. We now have 2 weeks to try and get in done. IF we were doing it through a non profit we could but since we can not risk the job we can NOT have him do the service. Will that be defendable in a court situation?

I called 911 on my room mate who was very intoxicated and decided to jump from my 2nd floor balcony. When he moaned about his back pain I called 911 for help. During the call they asked where he was, and I realized a few seconds later that he drove off in his car! They asked if he had been drinking, and of course I told them yes. They located him and he tested .213 on the breath test. He also busted his lip in the jump off the balcony and when authorities noticed it he told them he feared for his life and that I was beating him! I know police have to follow laws and procedures. Making a judgement call to allow an intoxicated driver with a bac of .213 to go free without citation or legal ramifactions doesn't seem right. I've read the laws in Utah Regarding DUI laws. I've yet to come across a reason to not cite the driver, let alone take his excuse as a reason to "arrest" another who wasn't in the car. Did they charge me because I have a record, and I was an easy target? Or is it just normal for police not to report on field sobriety test results to a judge so they can make the call?
