I blew a .16 and I want to switch careers and I am afraid that having a DUI perse/ PBJ will not let me change careers. Does a PBJ still count as a "conviction". I was told that it doesnt mean you are guilty or innocent. Is there no way to get it expunged even if I fill out a form for the governor? I would like to teach in a different country, but I'm really afraid this will be on my federal background check. I am really afraid that I will be stuck in the same career, for such a foolish night. Any advice would be appreciated. This all happened in the state of Maryland.
A PBJ is not a conviction, and it is not a guilty finding. Both the "guilt" and conviction have been set aside....
The only reason I was unable to get pbj at the trial was due to a Federal DUI conviction (US Park Police - I-295) on my record from 2007 which carried 0 points and was not sent to MVA. The judge said she would reconsider granting pbj based upon completion of 6 months of supervised probation, and 26 weeks of drug/alcohol classes. Now MD MVA is trying to suspend my license for another 180 days (currently half way through initial 180 day suspension) based upon the 8 points connected to the conviction, however if pbj granted 0 points on my license. All legal parties seemed very confused by Federal DUI and I fall in some legal grey area for probation before judgment. I am unable to join interlock program since I no longer own or have access to a vehicle. What can I expect at MVA hearing?
You should speak with an attorney. It is possible to have the MVA hearing delayed, but certain paperwork must be filed...
Classes such as www.myduiclass.com. I will be moving out of state very soon. I was going to pay for 12 hours to meet the AEP requirements. I have an out of state license.
Online classes are typically NOT accepted by the Maryland Courts. There are, however, several providers that will...
First time offender, officer pulled me over after I tried to slip through a yellow light. Performed poorly on the field sobriety test, arrested and taken to the station where I blew a .20. My general understanding is that I should be able to retain my driving privileges, and hope for probation before judgement, if I enroll in an alcohol treatment program and have an interlock device installed for 1 year. Is there any way to legally keep driving without the IID? If I elect to face the 90 day suspension instead of having the IID installed and use public transportation to get to and from work, should I expect to be judged more harshly at court? Thanks for the help.
There are defenses to the administrative sanction of a breath test test result of .15 or greater. If you win the...
From Lancaster to Md during rush hour. En route to see PO of 3 years with 2 months left. Unsupervised also. Had papers to go over. I had a rental and had been driving for 90 min. About 5 miles to go and had a minor accident. I took responsibility for it. No one was hurt. An officer came to swap info and move things along. Said byes and the 3 of us went on our way. The first officer started off & just before he left another officer came behind me, & waved the other driver away . Cop #2 first accuses me of driving without consent. He was confirmed wrong. He then says he smells alcohol. What! Had I been drinking? Of course not, I say. On my way to see PO, been in car for 1 and half hrs. This seemed strange & heading in an even stranger direction. There's more but any thoughts so far?
Too much info missing to give an opinion. You should seek a private consultation with an attorney experienced in...
