I had been drinking at my house with my girlfriend who was over. She decided to leave around midnight while it was raining. I did not want her to walk alone through the streets while it was dark and raining so I jumped in the car to go pick her up. I pulled into a parking lot near where she was walking and jumped out of the car to go talk to her. I left the car running and while we were standing talking a cop pulled up. He asked what we were doing and I said I was picking up my girlfriend to bring her home. When asked if i had been drinking I said I had a few. Was given a field sobriety test and declined breathalyzer until getting to the station where I blew a .16. I have no other offenses except for a speeding ticket two and a half years ago and one this year. What should I be expecting
My thought is that you need a lawyer and you need to be careful what you say in a public forum such as this.
When the trooper smelled smoke & asked if I'd been smoking, I admitted I had. Trooper asked if it was still in the car. I said it was. He asked me to hand it over & I did (about a gram or 2 max), along with my pipe, with some weed left in the bowl. The trooper allowed me to drive myself to the local police station and arrested me, forgoing bail. I've been given a summons to appear in court to enter my plea. Is there any reason to plead not guilty, since I voluntarily handed over my stuff? What sort of fine am I looking at, with no prior record (only 2 traffic tickets in 25 years)?
I think you should let the case work itself out. As an attorney, my ears quickly perked up when the Trooper alleged to...
It was my first time ever getting pulled over for anything. I was completely cooperative, poor judgment. I consented to a breathalyzer test, blew a .23. The police officer told me that because I was so cooperative, he was going to recommend the charges be dropped to his Chief. He told me to call the chief first thing Monday morning.
It is possible, but with that high of a breath test, it is not probable.
an undercover officer arrested my son while he was walking to a an outdoor concert - the beer can wasn't opened and they handcuffed him and he had to be bailed out, but he wasn't intoxicated and he didn't have to blow...but they never read him his rights. Shouldn't they have read his rights when he was arrested? and what could happen to him? His first offense never been arrested before and it was off campus and he lives out of state. He was also very respectful with the arresting officer.
The police are not required to provide Miranda warnings unless they intend to question your son after he is under...

You will only face jail time if you are convicted of a DWI subsequent or aggravated charge. You should consult with a...
Pending case is May, however now thinking about pushing out so he is not denied entry. Looking at Canadian border rules thinking he should just try and get temp visa, but unsure if he can get by June. If this is not even in the border system maybe he will not get denied .Looking for info. Fyi first offense, was visiting daughter at VT who was meeting him to drive him across the street to hotel. Someone called and cops pulled up behind as soon as he started car to warm-up, cuffed him and took him away with college daughter just arriving to drive him. Phone records show this, He is not a drunk and great father, would have been nice if Front desk clerk would have asked if he was all set before calling cops after he walked out. He did not even drive. Group of us going to do a triathlon.

in 2008 I moved out of Forida. I got a dwi in New Hampshire in 2009. I was a resident of New Hampshire but didn't change over my licences. now years later I've fixed both states to get my license back. told I have to now reinstate my Fl, license first. Yet they know I'm a resident of New Hampshire for 5 years now. I'm eligible to Drive in NEW HAMPSHIRE & in Florida I've done everything as well. but they say only if I reinstate fl first that I won't get my new Hampshire license. my questions are basically how can I reinstate a license when they won't send me a Florida id when I do it . because they know I'm not a fl resident. so id be reinstating my license in Florida yet not getting the license id card. and then I still have to get reinstated in NH , which I never even Had a NH license
You had a FL driver's license when you were convicted of DWI in NH. Therefore, your driver's license in FL must be...
