According to § 3806 of the Vehicle Code - Prior offenses; a "prior offense" is based on the conviction date of that offense. I have had 3 previous DUIs in the past. I incurred two DUI's in 2001 within months of each other. I was granted ARD for the first one (before I got the 2nd one), and I got another a few months later. They revoked my ARD and resentenced me on the first DUI, and sentenced me on the 2nd DUI on the same day circa August 2003. I got another DUI after that and plead guilty in 2004. I got another DUI in 2/13, and the district attorney is charging me with a 4th offense DUI. Can anyone help me clarify how the district attorney is charging me with #4?

this is my first offense. i have had no priors on my record. i am an honor student at one of the most prestigious schools in the area. i dont know if the judge takes any of this into account when deciding punishment, but if he/she does it could effect the decision
The good news is that your juvenile status provides you with some leeway. The juvenile system is very different from...
My 20 yr old daughter got a DUI in NY, but lives in PA and has a PA license. In the preliminary trial, NY suspended her license, in NY. She was also to sign up for the ARD program, but didn't know if she could do it in PA and if that would be acceptable in NY.
Since your daughter was charged in New York, the DUI charge must be handled and resolved there. However, if your...
