I met with friends at a restaurant had one drink then a friend drove us to a bar. I had a couple more drinks. We then went to his house and hung out (not drinking). Then he dropped us of where our cars where. I felt fine and drove home. I was texting and then hit a parked car. I left out of panic. In the morning i realize that i need to call my insurance so i was on my way to see the damage from the other car. I saw cops by my car and then i told them the quick version of what happened. once they heard i did have something to drink that is all they focused on. I did take a breathalizer and it read 0.05. How do i proceed with this?

I've seen a lot of reasons for re testing blood, but it seems to me that there is a chance, especially with a high bac (say like over .20) that after a month and a half or whatever, some of the alcohol could dissipate between tests. is this accounted for in a retest? thanks!

I have a case of dui+controlled substance and can't decide what type of attorney is best suited to handle my case to avoid jail time. 1)Should I hire an attorney who has mainly dui case experience so they can knock that off (to avoid the double whammy) or hire someone who has more criminal defense experience? 2) Is an attorney who has been a prosecutor before more likely to be less sympathetic to my case or more likely to have better intimate knowledge of the DA's intentions and have a better chance of defending me?

In May 12, 2005 I got arrested for Misdemeanor DUI that registered 0.14 on the breathalyzer which denied approval for my citizenship on DEC 14, 2005 . After my informal probation of 3 years ended in May 12, 2008 , I got another Misdemeanor DUI in 09/07/2008 with an alcohol level of less than 0.14. I was again placed on probation which ended on 09/08/2011. I wanted to know if I'm eligible for Naturalization? Any Professional Feedback is Appreciated

On 4/17/2013, the U.S. Supreme Court ruled that "the natural dissipation of alcohol in the bloodstream does not constitute an exigency in every case sufficient to justify conducting a blood test without a warrant." I was arrested in 2012, but my case is still in pretrial phase, no Motion to Suppress Evidence has been filed yet. My question is whether Missouri v. McNeely applies to DUI searches in California prior the 4/17/2013 ruling? see Davis v. United States, 131 S. Ct. 2419 (2011)
Obviously there is no case law on that specific issue but I bet it does.
