I was misdemeanor arrested for driving under influence at Illinois, USA in November 2009. I was punished fine by the court, victim panel presence, 10 hrs of DUI classes and 1 month driving license suspension. In last 8.5 years in USA I have one speeding ticket in 2005 and one DUI in 2009. Ever since I did not committed any kind of violation till today. 1. While filling DS-160 online application, do I need to check ‘YES’ when it ask ‘Have you ever arrested or convicted’? 2. If I check yes, is there a chance to get my visa stamp successfully? 3. Do I need to go through panel of physicians? 4. Will they give me 221g during my visa interview? 5. If I receive 221g, how long would it take to get clearance from this process? (As I am going to India from October 25th 2013 – December 24th 2013)

If you have proof of one year of attending AA and no further incidents, there should be no bar to your admission.
I got arrested for a DUI & Following to closely. I was diving a motorcycle and following my acquaintances because I did not know my way around that city. The officer went on to administer FST's which he stated that I failed. When he gave me the PBT it made me cough because I vomited not 15 minutes before they arrested me. (I did not mention I vomited but I have witness that can attest to this) On the sword statement, he said I refused to provide sample; however, on the sworn statement he put that my PBT read 0.163. Whilst in jail, I vomited again so they did not give me breathalyzer. And had to pee really bad so the officer ended up not taking a urine sample. (He said wait till you provide sample to pee.) The arrest took place more than a year ago. The charges were reduced to reckless driving adjudication withheld after my lawyer entered a "No contest" plea and I only had to pay 300$ fine nothing else. I am an experienced software developer and have a job currently. Currently I am considering an offer from another software company. Can this incident affect me adversely during the employment background check if I declare the incident honestly? How much details of the arrest record should I provide in the background application form? Should I tell that initially I was charged with DUI, then entered no contest plea and then it got reduced to reckless with adjudication withheld? or Should I just say I was arrested once and got reckless driving with adjudication withheld?

Can i be charged of DUI if i am just sitting in drivers seat, i parked my car in private parking , engine off, keys out in my hand, most important car was out of petrol, can move barely few miles, Police saw me drinking inside the stopped car, they charged me of DUI.Pls advice.

I was convicted for a DUI in 2008 and it was a felony because my license were suspended at the time for a previous DUI. I was told that DUI"s can not be expunged or sealed so I trying to see if there any other options I don't want it removed because it was my own fault , but I want it were others like school for example can't see it.
