So my husband got arrested for dui in our dooryard. Our next door neighnor said they say him driving while being intoxicated so she called the cops. They showed up and the husband of the next door nieghbor walked down and punched my husband in the face in our yard. . The cop said to my husband that he was being arrested for dui. They brought him to the hospital to get his nose checked out then they brought him to the police station to do a breathalizer. Of course he blew numbers cause we were having drinks at our house. So now because the neigbor said they saw him and he blew numbers there charging him when he never was on the motorcycle. Our next door neighbor hates my husband for past issues. I've done time, paid fines, completed CRASH program, ongoing counselling , and had driving privilege restored in VT. NY says I need to pay assessment of $750+$25 only. PA suspended me on 5/25/10 for a citation from 11/25/07 and am suspended til 5/7/15. I was in prison in VT from 3/08 til 8/10, unable to answer PA til they transported me to PA from VT in 5/10. Doesn't suspension begin on the date of dui? I am in dire conditons and have mitigating circumstances to appeall to NY & PA. I blew a . 094 on the road and then a . 096 at the police station . I then went to a small town hospital ( closest one according to him ) on the list the cop gave me for independent blood analysis . He told me to just " hand the box / kit to the hospital " and they'll know what to do . I did this and hospital staff was very confused on what to do and called a doctor at his home about what to do . They took my blood , sealed and signed the kit , and because they had no courier to take deliver , they then proceeded to give me sealed kit to mail it myself . Unbeknown st to me it has to kept at a certain temperature otherwise it gets spoiled . So now I'm left with this kit that won't help me . Now my question is , how is this okay and legal ? My chance to prove myself innocent is completely destroyed now .

Did not do a breath or blood test. Spoke with a public defender and she told me to not believe what this individual said. I have not received the complaint information yet. Reveived a notice for license supenstion as well, should I request for hearing? I would think so. What do I do now?

Had a NC license when arrested 8/28/11 - convicted guilty 12/1/2011. Was placed on 120 day unsupervised probation ending 3/31/12 . My community service charged was 48hrs for Cabarrus NC but I moved to VT 2/23/12 after notifying my Community SVC Officer/ My Attorney of my new address in January 2012 stating I needed to work out of state since I was unemployed now. I completed 6hrs in Cabarrus before I left then added 33hrs in Addison by 11/30/12. Cabarrus NC never recorded move, nor was I notified of 'No Show Cause' in February 2012/never served to appear in court. Then submitted to Cabarrus in April proof of change address/called 11/28/12 to Cabarrus to learn next steps for license return only to learn I have an arrest warrant. I have court 12/10/12 and since 5/2012 VTDMV took over.

My friend blew a .000 even though he had been drinking. The officer gave him a ticket because he was in possession of the alcohol I bought and told me that he could arrest me but wasn't going to cause a scene. This happened in VT. I was told I could drop my friend off and then come back to the police station where I would give my finger prints and other info. I went to police station and the officer took my info down, my photo, my fingerprints. He then asked me if I had ever been arrested before and I said, no. He then informed me that this was an arrest and never once read me my rights. He then informed me that I could get the charges dropped if I knew of any drug dealers that I could give them info on. I am a hard working never been in trouble person. I don't do drugs.
