My husband no question, has a drinking problem, and a problem with common sense too it seems. He had his first dwi in2008. He was put on probation with a suspended sentence. He was charged with a level4 dwi. His 2nd dwi was in 2009. He was sentenced 24 months in doc with 90 day DART program. He was sentenced on April 7th 2010. Im 3 months pregnant, so my husband appealed the sentence and his appeal date is June 14th 2010. He also has a pending 3rd dwi case on June 18th. my question is...what is the worst and best possible outcome of this situation? Can I be charged with dui after the fact if the cop didn't perform and tests and reveal that he thought I was drunk. Just trying to figure out if he gave me a break or wasn't suspicious at all. Needless to say I have learned my lesson and will never be putting myself in this kind of situation again.
Without any hard evidence (such as field sobriety tests, a breathalyzer, or drawn blood) it would be difficult but not...
