My sister and I had just drove all over town, We stopped in a bar by the house and had drinks we got into an altercation while getting our stuff out of the car to walk home and the cops came they gave us both disorderly conduct and I got a DUi. I wasn't driving, I wasn't even in the car. I have never been in trouble not even a speeding ticket. What's the best way to fight this, no one seen me driving, the car wasn't running but the engine was still warm from running around. I was only at the bar for about an hour. They gave me a breathalyzer but never told me what it was and it's not recorded on my paperwork anywhere. 12 hours later it was 006. I had 2 jack and cokes and I Vegas bomb.

I refused a chemical test on the side of the road and in the back of the police cruiser without talking to a lawyer. I was taken to jail. Before I was booked I told the officer that I consented to a breath test. He told me that he had already given me enough chances and that he would not allow it. Then he asked me to sign some express consent form and I refused to sign it without a lawyer because the refusal box was already checked. I am just wondering if there will be a chance for me to bring this up at my DMV hearing and maybe save my license. I learned from a previous post on this site to apply for a hearing so that's what I did. My report even says I consented at the station but the officer had already given me enough chances. Any help would be greatly appreciated!

Ok I had a interlock in my car last year. My car was broke down and I didn't have the money to fix it. I took it to the juck yard. Called the DMV,interlock company that same day. I have poof of calling them. I have been out of work. Then I had two hearings last month. The first one the hearings officer said that he didn't have my proof. Then I called his suppervisor and he told me that he will tell him where my proof was. A week later i have a hearings and the officer said since keeped the interlock 2 months after I got rid of the car cuz I was out of state. I was guilty of 42-2-132.5 I just got a job. I want to fight this in appeals court and to be able to get a car with a interlock. So how hard would it be to win in court?
