i just took a plea from the DA at central islip court for 1 year interim probation and pleading to a dwi. I have been told both that i will be eligible for a conditional after the dmv gets report of the conviction and i have been told that i am not because interim probation is not actually a charge. I would like to know the answer as my current attorney is impossible to get a hold of on this matter.

I have a friend who was involved in a DUI arrest last night and I am wondering what legal implications he may face if convicted. He is a college student and made some very serious/idiotic mistakes. This event took place in New York State. From my understanding he has no prior criminal record. These are the offenses from what I know however he has not been arraigned yet -Driving without headlights on -Driving without a valid drivers license -Driving while intoxicated while under 21 (I do not know the exact BAC) -Providing a false name/information to the police -Resisting Arrest (supposedly was screaming at police officers, they used force against him to restrain him) Looking at these potential charges, what could one expect as a legal penalty? The car driven did not belong to him.

I was convicted of DWI back in January 2011. Part of that sentence was a a 6-month jail term and a 1-year conditional discharge. The conditional discharge was set to expire on January 4th, 2012. I went to pick up my license from the DMV yesterday (January 14th) and was told I still needed an interlock device, however, with nobody to monitor it (courts or probation) all interlock companies I tried to schedule installation with claimed that they cannot install a device. Is this a DMV issue or does this have to involve the courts now?

I would speak to the attorney that sentenced you...its one of 2 things however...either the court ordered the interlock...

Hello, I recently got offered a deal where my DWI charge would be knocked down to an impaired. However I have to do a year of interim probation for this to happen..My questions is what is the difference between Interim probation and regular probation for a misdemeanor/felony?. What are the guidelines I have to follow? How bad will it be? Will they really check upon me? What do I have to prepare for? Any answers will be greatly appreciated.

I served jail time and completed DDP (got DS-449). My license was revocated for 5 years. Now that the revocation period has ended, I've applied for my license and was denied. I was denied based on new laws that were not in effect at the time of my conviction in 2007. I was told I could not have my license back until a 25 year period has lapsed. Can I be held to the new laws that were introduced 5 years after my case was closed? If so, would I be eligible for a conditional and/or restricted license based on a hardship? As a result of my mistake, I am now a stay at home dad with no ability to work or assist my children to from doctor/school, etc. I'd like to take some of the burden off of my family.

There are exceptions to the new regulations that you could fall into. No one can tell unless they review your history...

My friend, whose license was suspended at the time, let me drive his parents car while we were together one evening. We had been drinking and I totaled the car and was charged with a DUI. In addition, his parents claimed the car stolen and I was charged with grand larceny, which has since been dismissed, after the insurance company paid the claim. The insurance company is now saying I am liable for the damages because the car was stolen. Can they do this? Also, if I plead to the DUI with interim probation to a DWAI, can the insurance company hold me liable?
