my dui is over a year old, i plead guilty, went to my required classes, paid all my fines and fees on time.
Sounds like you are already sentenced a beyond the period that allowed you to withdraw your plea. I think you are stuck....
I was drinking at a bar with some people i knew and they got cut off and kicked out for the night, they were mad at the bartender and mad i wasn't kicked out so they vandalized our cars, i waited for the police to give them information about our cars and they asked for my social and ended up not giving me a choice but to blow in a breathalyzer and blew a .083, I was wondering if there is anyway to fight it or get a bargin plea so i don't get it on my record or lose my license, i wasn't near or in my car and i was just there to help out which they thanked me for but now i have court in 3 days i don't have a public defender and this is my first offense also i am 19
Are you charged with an underage DUI, Public Intoxication, or what?
First ever offense for an OVI, refusal, but ended up being honest about a urine test and turned into drug punishment??
I have never been in trouble with the law, and only had 1 prior speeding ticket in last 6 years. Im a 33 year old sales professional & single mother. I was pulled over for marked lanes, by an Ohio State Patrolman, I did field sobriety test (relatively well as far as me and atty was concerned) but refused to blow. Had a very well known attorney but decided to plea. I received 6 months Suspended license and 6 months probation with random drug/alcohol tests. My atty held a sidebar to inform the judge privately that I would have marijuana in my system... the next thing I know is Im being punished for smoking pot when it NEVER had anything to do with the case to begin with. Many of my friends/relatives have had DUI's and never received random testing & probation. Was this allowed? How does a case go from an OVI to an OVI marijuana case? Please help me understand...
You have an attorney. It would be unethical for another attorney to advise you. Your attorney is the best one to ask....
This was my second DUI refusal and the case was dismissed. What are the chances of Ohio BMV dropping the suspension?
I was pulled over and arrested for a DUI and refused to submit to a chemical test. This was my second refusal in 6 years. The case ended up getting dismissed because the officer had no lawful reason to pull me over. However, my license is still under suspension by the BMV because it was the second time I refused a chemical test. I know my lawyer can petition the BMV to drop the suspension, but what are the chances of the BMV actually dropping it when the charge was dismissed?
I'm not licensed in OH so I recognize differences in the laws and procedure in our neighboring states may result in...
I was pulled over for speeding (81 in 65) on the interstate. I was given sobriety field tests and was placed under arrest. The ticket says reasons for arrest: Speed, Odor, Eyes (and something illegible as the last reason). From the time I was pulled over, it had been 4 hours since I had a drink. At the station, I blew .082 (.002 over the limit). How likely is it to have this dismissed? I am devastated.
No chance at all this will be outright "dismissed" by the prosecutor. However, a good OVI attorney could definitely...
On probation for a dui. After about a year on probation I received a minor possession of alcohol. What is likely to happen?
I meet with my probation officer before the court date for the possession and plan to tell her. The officer giving me the ticket said nothing about my DUI charge or me being on probation.
You should consult with your attorney for guidance. Don't do anything without talking with them. Good luck.
If I accept a plea of reckless operation for a DUI, how quickly will I get my license back. Do I still have to serve the rest of the ALS or can I resume regular driving privileges after accepting the plea? Also if I choose to motion to supress evidence, yet nothing is suppressed am I forced to still go to trial or can I backtrack and accept the plea at that point?
You cannot backtrack and accept the plea. The plea will be withdrawn if you do a motion to suppress. How fast you get...
