Can a probation officer who has a conference with a person for a conditional discharge(presentencing conference with a probation officer)recommend probation instead of a conditional discharge simply because the person has been convicted of the same charge before.The court recommended the conditional discharge,po said she recm’d. probation since second charge is a felony.Will the judge make a decision himself or just take PO’s recommendation.The judge recommended the conditional discharge in the 1st place to the ada.I feel like I was schooled cause the ada offered the probation to begin with in plea bargain but I turned it down until the judge recommended the conditional discharge which I said I would settle for and signed paper not to appeal instead of taking to trial.im confused

I just got a DWi in NY(i am a licensed NY driver) this past week i blew a .12 in Nassau County, but i am also pending on previous DWi case which i have in NJ where i blew a .16. I still havent gone to court for the one in NJ, and the court in NY knows about the open case in NJ. Another fact to the case is that i am currently under 21, with no priors, and no accidents were involved, and noone was hurt.

It has been 4 months since this happened..I go back to court on August 4th I haven't been charged with anything yet. A week ago one of the oficers that arrested me called me at home and told me that the F.B.I had rejected my fingerprints and that I needed to come o the police station and redo them. He even offered to come to my house and pick me up. When i told him the date of my court date he said that we needed to have it done before then. I never had my fingerprints taken at the police station, so I'm kind of thinking that he might of forgotten to take them. Could this help get my charges reduced or dismissed?

I was convicted of a DWI in September with 3 yrs. probation. Today I received a letter that says I have to reappear to court for Revocable Sentencee Reappear. It also says that I am not in voilation of my sentence, and that I'm reappearing to the provisions of law CPL 410.40. What does this have to do with?
