My husband was originally arrested for numerous charges, including DWI. He was not convicted of DWI, and this charge has been sealed from his criminal record. However, I realize that the DMV is a separate entity to deal with. His license was suspended immediately due to a chemical test refusal. It was then revoked after a DMV hearing. Is it possible to remove this from the driving abstract? Will it ever go away after a certain time period, or will it be on the record permanently? What about if we move to another state? Thank you.

According to documentation my license was to be revoked for 1 year. I recently (this morning) was told that I can apply to the Driver Improvement Bureau all I want, but they will NEVER allow for me to become licensed again. Leandra's Law was signed in Nov. 2009, and went into affect Aug. 2010, Why, if in fact was I charged under the Leandra's Law if I was arrested prior to?

I was getting ready for work one morning a little earlier than usual and when I gave my breath sample to the interlock it failed. After a few minutes of panic later and I ate some bread and rinsed my mouth out with water. I gave another sample and it failed. I got a lockout. I didn't drink before work or the night before. I assume the mouthwash set it off? I checked and it's about 13% alcohol. What could the judge do?
