I missed an appointment with my probation officer because a) I misunderstood when he told me to come, I thought it was next week but in actuality it was this week and b) I have been working long hours that I slept right up until I was due to go to work that even if I had made it to my appointment I would have been late for work. Two friends and I were sitting at a stop light on an intersection in our town and a police officer rolls by and stares at us hard I then see this officer make a turn in an alley an come around to following us so I saw him and I followed all the traffic laws well he pulls us over and tells me I ran a stop sign. he then goes through the random questions and then procedes to ask us if we were on drugs or alcohol we said no I smoked the day before that so after that he goes around to the back of the vehicle and gets in my back passenger door and is back there looking for i would say 30 seconds and then comes out with a beer can. My friend was sentenced on a 2nd DUI highest tier in February 2008. He received 60 days with early release to DRC and house arrest for 1 month plus 5 years probation. He completed the DRC program.
In Feb 2010 he violated probation by drinking with a BAC of .13 and spent 7 days in jail, was given a warning, and was to get the alcohol bracelet the next day.
Seven hours after he got out of jail he was arrested for a 2nd violation because of drinking. The judge had counted the warning. A Drug and Alcohol evaluation said he did not need inpatient rehab. He received 90 days of jail time and 90 days of Intense Probation with the original 5 years of probation to be reinstated and outpatient rehab.
After 20 days he received his 3rd violation for drinking with a BAC of .275.
