I was stopped in a parking lot on my motorcycle after falling over (because of my feet). The police showed up and asked me to get off the bike. I have extremely deep foot ulcers on each foot. Part of my foot had to be removed 3 weeks after the arrest. The field sobriety test said I was wobbly and unbalanced. Can i get those test thrown out because of my medical condition. They also said that my eyes were watery and bloodshot, but I had been on my motorcycle for 10 hrs without goggles or eye protection.

A friend was pulled over for and took a breathing test. She blew over the limit, her car was towed, and was taken to the police station where she sat around for about an hour (they did paperwork I assume). She was asked to blow again and she blew under the legal limit and was told she could go. A week later she gets a ticket for "improper lane change." Two months later she gets a summons for an arraignment for a DUI violation. What are the best steps for her to take before the arraignment? She cannot afford an attorney. I am getting charged with a DUI of .20mg of Oxycottin, and since this is my first DUI, I felt no need for a Attorney and go for the Public Defender. But when my Public Defender offered me a plea deal of pleaing guilty on my Pre-Trial as the deal, I noticed she is not concerned whether or not I get charged with this or not. I am highly willing to fight this so I did not take her offer, so now I am reconsidering a Lawyer of my choice instead. But have doubts since I am so close to Trial if my case will be handled properly on switching Lawyers. And whether if it is better off to keep the public defender since she has already been dealing with my case. Or hire my personal lawyer????

I have two DUIs, but the second one is in a deferred prosecution. I'm right at the end of the first two years, a month away from completing treatment, and likewise parting ways with my PO. I just blew too high (barely) in my ignition interlock, and apparently its happened too many times, so I got an immediate "lockout". Every failure previously I followed with a clean blow, equating to a "false positive", not being reported to my PO or court. This time a second blow wasn't an option. I have my next interlock service in exactly one month, and by then I will be done with active probation with an officer, and I will have finished treatment (my last required class is in one week). Should I be worried? Can/will I lose my deferral for this? I have an otherwise spotless record...
